Արթուր Հովհաննիսյանը փաստաբանների նկատմամբ սանկցիա կիրառելու որոշումը խնդրահարույց չի համարում
POLITICSՀայաստանի Հանրապետության արդարադատության նախարարի առաջին տեղակալ Արթուր Հովհաննիսյանը դատական նիստերի ընթացքում փաստաբանների նկատմամբ կարգապահական տույժ կիրառելու մեջ վտանգ չի տեսնում:
Նրա կարծիքով բարեխիղճ փաստաբանների համար դա խնդրահարույց չի լինի: Ազգային ժողովում լրագրողների հետ զրույցում նշել է, որ նորմալ է վերաբերվում փաստաբանների նկատմամբ դատական սանկցիա կիրառելուն:
«Դատական տուգանքը, կարծում եմ, կարող է արդյունավետ աշխատել դատական նիստի բնականոն գործընթացը ապահովելու համար։ Ավելի խիստ պատժամիջոցներ էին քննարկում, որոնց ես ինքս դեմ եմ ներկա եղել։ Երկրներ կան, որտեղ կալանք պատժամիջոցն է կիրառվում»,- նշել է նա։
Պաշտոնյան նկատել է, որ միայն փաստաբանների նկատմամբ չէ, որ սանկցիա է կիրառվում: Ապագայում նաև դատախազների նկատմամբ է նախատեսվելու նման սանկցիա կիրառել։
Դիտարկմանը, թե դատախազներն ի պաշտոնե կաշկանդված են, բողոքի նշաններ ցույց չեն տալիս, մինչդեռ փաստաբաններն արդեն երկու օր է՝ գործադուլ են իրականացնում, Հովհաննիսյանը արձագանքել , թե փաստաբանների կողմից դատական նիստերին չներկայանալը նշանակում է, որ նրանք պատշաճ և բարեխիղճ չեն կատարել իրենց պարտականությունները։
«Օրենքով նախատեսված է փաստաբանի երդումը, որ պարտավոր է պատշաճ ու բարեխիղճ կատարել իր պարտականությունները, պաշտպանել իր վստահորդի օրինական շահերը: Հիմա գործադուլը մի կողմից, մյուս կողմից էլ վստահորդի շահերը, արդյոք այստեղ խնդիր չկա՞», -նկատել է փոխնախարարը։
Նա հավելել է, որ փաստաբանի տեսանկյունից նայելով, ինքը որևէ խնդիր չի տեսնում, որովհետև փորձը ցույց է տալիս, որ եթե փաստաբանը կարող է իր վստահորդի շահերը լավ պաշտպանել՝ առանց խախտելու դատավարական կանոնները, ուստի որևէ խնդիր չի առաջանա։ Նրա խոսքով՝ դատարանը արհեստական սանկցիաներ երբևէ չի կիրառել, դրա համար բարեխիղճ փաստաբանի համար այս սանկցիաները բացարձակապես վտանգ չեն ներկայացնում:
