Մեկ օրվա ընթացքում մեկից ավելի երկրում գործուղման գտնվողների օրապահիկը կհաշվարկվի միջինով

 ՀՀ տարածքից դուրս տեղափոխման (տեղաշարժման) բնույթ կրող աշխատանքների իրականացման դեպքում լրացուցիչ ծախսերի գումարի հատուցման, և  մեկ օրվա ընթացքում մեկից ավելի երկրում գտնվելու դեպքում աշխատողի օրապահիկի (լրացուցիչ ծախսերի հատուցման) չափը որոշելու համար նախագիծը կարգավորման կարիք ունի:

Այն անհրաժեշտ է փոփոխել: Երբ տեղափոխման (տեղաշարժման) բնույթ կրող աշխատանքներն իրականացվեն ՀՀ տարածքից դուրս,  աշխատողների կողմից կատարվող լրացուցիչ ծախսերի գումարի հատուցման նվազագույն չափը պետք է համապատասխանի օտարերկրյա պետություններ գործուղվող աշխատողների օրապահիկի համար հաստատված չափին:  

Բացի այդ, այն դեպքում, երբ գործատուի անհատական իրավական ակտի համաձայն՝ տեղափոխման (տեղաշարժման) բնույթ կրող աշխատանքներում աշխատողը մեկ օրվա ընթացքում գտնվում է մեկից ավելի երկրում կամ քաղաքում, ապա հատուցման գումարը պետք է վճարվի համապատասխան երկրների (քաղաքների) համար նախատեսված օրապահիկների միջինի չափով:

Գործուղման օրապահիկի վճարման, իսկ տեղափոխման աշխատանքների դեպքում՝  աշխատողների կողմից կատարվող լրացուցիչ ծախսերի հատուցման կարգավորում պետք է նախատեսել այն դեպքերի համար, երբ աշխատողը գործուղման կամ տեղափոխման բնույթ կրող աշխատանքներ իրականացնելիս  մեկ օրվա ընթացքում գտնվում է մեկից ավելի երկրում:  

ՀՀ կառավարության 2007թ. մայիսի 3-ի N 542-Ն որոշման 1-ին կետի 1-ին ենթակետի համաձայն՝ դաշտային պայմաններում կամ տեղափոխման բնույթ կրող աշխատանքներում աշխատողների կողմից կատարվող լրացուցիչ ծախսերի գումարի հատուցման նվազագույն չափը համապատասխանում է ՀՀ կառավարության 2005 թվականի դեկտեմբերի 29-ի N 2335-Ն որոշման N 2 հավելվածով ՀՀ տարածքում և ԼՂՀ գործուղվող աշխատողների օրապահիկի համար հաստատված չափին: Սակայն որոշմամբ կարգավորված չէ ՀՀ տարածքից դուրս տեղափոխման բնույթ կրող աշխատանքներում աշխատողների կողմից կատարվող լրացուցիչ ծախսերի գումարի հատուցման հարցը: Միաժամանակ չկա դրույթ այն մասին, թե աշխատողին, որ երկրի  օրապահիկը պետք է վճարվի այն դեպքում, երբ նա մեկ օրվա ընթացքում գտնվում է մեկից ավելի երկրում կամ քաղաքում:

Այս հարցի կարգավորման նպատակով ուսումնասիրվել է միջազգային համանման փորձը, որի արդյունքում պարզվել է, որ տարբեր երկրներում կիրառվող մոտեցումները խիստ տարբերվում են: Օրինակ՝ ՌԴ-ում գործուղման վկայականների առկայության դեպքում հնարավոր է բոլոր երկրների համար նախատեսված օրապահիկների վճարում: Ուկրաինայում հիմք է ընդունվում համապատասխան երկրների համար նախատեսված օրապահիկների միջինը: Որոշ երկրներում էլ հատուցման համար հիմք է ընդունվում այն երկրի օրապահիկը, որի չափն ամենաբարձրն է: 

Արդյունքում, նախագծով որոշվել է գործուղման ժամանակ, ինչպես նաև ՀՀ տարածքից դուրս տեղափոխմանբնույթ կրող աշխատանքներ իրականացնելիս մեկ օրվա ընթացքում մեկից ավելի երկրում գտնվելու դեպքում աշխատողին իր օրապահիկը վճարելիս հիմք ընդունել համապատասխան երկրների համար նախատեսված օրապահիկների միջինը:
