Անտառապահը արդարացվեց՝ հանցակազմի բացակայության պատճառով

9 ամիս ճաղերի ետևում անցկացնելուց հետո հանցակազմի բացակայության պատճառով Տավուշի մարզի առաջին ատյանի դատարանը՝ դատավոր Ռաֆիկ Մելքոնյանի նախագահությամբ, այսօր արդարացման վճիռ է կայացրել «Դիլիջան ազգային պարկ» ՊՈԱԿ-ի Հաղարծին մասնաճյուղի անտառապահ Կամո Պողոսյանի նկատմամբ: Շուրջ 9 ամիս կալանքի տակ գտնվելուց հետո նա այսօր, ժամեր առաջ դատարանի դահլիճից ազատ է արձակվել:
Հիշեցնենք, որ նրան մեղադրանք էր առաջադրված եղել ՀՀ քրեական օրենսգրքի 311-րդ հոդվածի 3-րդ մասի 2-րդ կետով՝ մի խումբ անձանց կողմից նախնական համաձայնությամբ կաշառք ստանալու մեղադրանքով:
Կամո Պողոսյանի պաշտպան Կարեն Քամալյանը Past.am-ի հետ զրույցում նշեց, որ ազատ արձակման վճիռը դատարանը կայացրել է հանցակազմի բացակայության և ապացույցների անբավարարության հիմքերով:
«Ես այս պահին չգիտեմ, թե դատարանը որ հիմքով է արդարացրել իմ պաշտպանյալին, բայց երկու հիմքերն էլ առկա էին, որպեսզի Կամո Պողոսյանն արդարացվի: 9 ամիս նա նախնական կալանքի տակ էր գտնվում, անընդհատ բողոքարկում էինք, բայց և՛ առաջին ատյանը, և՛ վերաքննիչ դատարանը մերժում էին: Այսօր նոր այդ տարեց, վատառողջ մարդուն բաց թողնելու որոշում է կայացրել դատարանը»,- ասաց Կ. Քամալյանը:
Պաշտպանը նշեց, որ եթե իր պաշտպանյալը ցանկություն ունենա 9 ամիս ճաղերի ետևում անցկացնելու համար իր կյանքին և առողջությանը պատճառած վնասի փոխհատուցման պահանջով դիմել դատարան, ապա անպայման կդիմեն:
Հիշեցնենք, որ ըստ մեղադրական եզրակացության, Կամո Պողոսյանը 2017թ. մարտի 21-ից աշխատելով «Դիլիջան ազգային պարկ» ՊՈԱԿ-ում որպես Հաղարծին մասնաճյուղի անտառապահ, նույն կազմակերպության հատուկ ջոկատի տեսուչ Արմեն Սարգսյանի հետ նախնական համաձայնությամբ 2017թ. մարտ ամսվա վերջերից մինչև ապրիլի սկիզբը ընկած ժամանակահատվածում Տավուշի մարզի Հաղարծին գյուղի բնակիչ Սամվել Թամրազյանից ստացել է 140 000 ՀՀ դրամ կաշառք՝ վերջինիս օգտին ակնհայտ ապօրինի գործողություն՝ «Դիլիջան ազգային պարկ» ՊՈԱԿ Հաղարծին տեղամասի 6-րդ պահաբաժնից ապօրինի հատված ծառերը և փայտանյութը անտառից ապօրինաբար դուրս բերումը և Ս. Թամրազյանի կողմից սեփական հայեցողությամբ տնօրինումը թույլ տալու համար:
Նշենք նաև, որ մեղադրող կողմն իր մեղադրական ճառում միջնորդել էր Կամո Պողոսյանին դատապարտել 6 տարվա ազատազրկման:
