Փաստաբանները դիմել են ՀՀ Նախագահին քաղաքացիական դատավարության օրենսգրքի փաթեթը ԱԺ վերադարձնելու խնդրանքով
SOCIETYՓաստաբանների նախաձեռնող խումբը դիմել է Հայաստանի Հանրապետության Նախագահին՝ ՀՀ Ազգային ժողովի կողմից ընդունված ՀՀ քաղաքացիական դատավարության օրենսգիրքը և փաթեթի մեջ ներառված օրենքները համապատասխան առարկություններով և առաջարկություններով ՀՀ Ազգային ժողով վերադարձնելու և քննարկում պահանջելու խնդրանքով: Այս մասին past.am-ին տեղեկացրին ՀՀ Փաստաբանների պալատի մամուլի ծառայությունից:
«Փաստաբանները գտնում են, որ ՀՀ քաղաքացիական դատավարության օրենսգրքի նախագծում առաջին ընթերցումից հետո ավելացված` փաստաբաններին տուգանելու վերաբերյալ իրավակարգավորումը չունի հիմնավորում, և առկա չէ այդ իրավակարգավորման ընդունման անհրաժեշտությունը, ինչպես նաև դատական տուգանքը կարող է վտանգել փաստաբանի անկախությունը:
Նախաձեռնող խումբը բազմիցս իր մտահոգությունն արտահայտել է փաստաբանների նկատմամբ որպես սանկցիա տուգանք կիրառելու լիազորությամբ դատարաններին օժտելու կարգավորումների վերաբերյալ՝ նկատի ունենալով, որ դատարաններին փաստաբանների նկատմամբ նման լուրջ լծակի վերապահումը կարող է բացասաբար ազդել Հայաստանում փաստաբանության ինստիտուտի անկախության և փաստաբանների ինքնակառավարման կառուցակարգերի հետագա կայացման գործընթացի վրա՝ դառնալով փաստաբանների վրա ճնշումներ գործադրելու առիթ և միջոց»,- ասված է դիմումում:
Դիմելով ՀՀ Նախագահին՝ փաստաբանները խնդրում են Ազգային ժողովի կողմից ընդունված ՀՀ քաղաքացիական դատավարության օրենսգիրքը և փաթեթի մեջ ներառված օրենքները համապատասխան առարկություններով և առաջարկություններով վերադարձնել ՀՀ Ազգային ժողով՝ պահանջելով նոր քննարկում:
Փետրվարի 8-ին Հայաստանի Հանրապետության արդարադատության նախարարի առաջին տեղակալ Արթուր Հովհաննիսյանը նշել է, որ դատական նիստերի ընթացքում փաստաբանների նկատմամբ կարգապահական տույժ կիրառելու մեջ վտանգ չկա:
«Դատական տուգանքը, կարծում եմ, կարող է արդյունավետ աշխատել դատական նիստի բնականոն գործընթացը ապահովելու համար։ Ավելի խիստ պատժամիջոցներ էին քննարկում, որոնց ես ինքս դեմ եմ եղել։ Երկրներ կան, որտեղ կալանք պատժամիջոցն է կիրառվում»,-ասել է Հովհաննիսյանը:
Նա նշել է նաև, որ եթե փաստաբանը կարող է իր վստահորդի շահերը լավ պաշտպանել՝ առանց խախտելու դատավարական կանոնները, որևէ խնդիր չի առաջանա։
2018 թվականի փետրվարի 9-ին ՀՀ Ազգային ժողովը 59 կողմ, 25 դեմ, 10 ձեռնպահ ձայներով ընդունել է ՀՀ քաղաքացիական դատավարության օրենսգիրքը՝ փաթեթով:
