Արա Բուդաղյանի կալանքը կրկին երկարաձգվել է

Սյունիքի մարզպետ Սուրիկ Խաչատրյանի դեմ մայիսի 20-ին իրականացված մահափորձի գործով մեղադրյալ Արա Բուդաղյանի կալանքը եւս երկու ամսով երկարաձգվել է:
Այս մասին, երեկ ի պատասխան armtimes.com-ի հարցին՝ ասել է Բուդաղյանի պաշտպան Հայկ Ալումյանը: Նա նշել է, որ նախաքննական մարմինը կրկին միջնորդություն է ներկայացրել Կենտրոն եւ Նորք-Մարաշ վարչական շրջանների ընդհանուր իրավասության դատարան, Բուդաղյանի կալանքը երկարաձգելու վերաբերյալ՝ որպես հիմնավորում ներկայացնելով այն, որ Արա Բուդաղյանը ազատության մեջ մնալով՝ կարող է թաքնվել քննությունից կամ խոչընդոտել գործի քննությանը:
«Նախ ես ցույց տվեցի դատարանին, որ քննիչի այն եզրահանգումները, թե իմ պաշտպանյալը կարող է թաքնվել քննությունից, իրենց տակ ոչ մի հիմք չունեն, քննիչը ոչ մի կերպ չի փորձել իր ասածը հիմնավորել, բացարձակ: Ես նաեւ նշեցի, որ ճիշտ նույն ձեւի 2008 թվականին Ժիրայր Սեֆիլյանը կալանավորվել էր (Ժիրայր Սեֆիլյանը կալանավորվել էր իշխանությունը բռնությամբ զավթելու կոչեր անելու համար.-Տ.Խ.) հետո Եվրոպական դատարանը գտավ, որ այդ կալանավորումը հակասում է եվրոպական կոնվենցիային. անձին կալանավորում են զուտ այն պատճառով, երբ իրեն մեղսագրվում է ծանր հանցագործություն: Նույն ԱԱԾ-ն եւ նույն Կենտրոնի դատարանն էր այն ժամանակ, ու ոչինչ այս 7 տարվա ընթացքում չի փոխվել, նույն ձեւի առանց որեւէ հիմնավորման ԱԱԾ-ն ներկայացնում է իր միջնորդությունները, նույն ձեւով Կենտրոնի դատարանը հլու- հնազանդ այդ միջնորդությունները բավարարում է: Ու նույն ձեւով Եվրոպական դատարանը արձանագրելու է, ու կրկին Հայաստանը մեծ տուգանքների է ենթարկվելու: Բացի այն, որ ես ցույց տվեցի, որ քննիչի միջնորդությունը ոչնչով հիմնավորված չէ, նաեւ ասացի, որ եթե դատարանը չգիտեմ ինչ մտավոր վարժությունների արդյունքում եզրահանգման գա, որ քննիչի միջնորդությունը հիմնավոր է, այդ դեպքում ուրեմն թող գրավ կիրառի եւ գրավով իմ պաշտպանյալին ազատ արձակի: Դատարանը, սակայն, քննիչի միջնորդությունը համարեց հիմնավոր, իսկ մեր միջնորդությունը՝ անհիմն: Մենք գրավի չափ չէինք սահմանել, ասացինք՝ մի չափ սահմանեք, որը ձեր կարծիքով կկանխի ձեր երեւակայության մեջ գոյություն ունեցող վտանգները: Դատարանի այս որոշումը կգնահատի Եվրոպական դատարանը»,- մանրամասնել է Ալումյանը:
Ի պատասխան armtimes.com-ի հարցին, Հայկ Ալումյանն ասաց, որ Արա Բուդաղյանը նույնպես ներկա էր միջնորդության քննարկմանը եւ իր կալանքը եւս երկու ամսով երկարաձգելու՝ քննիչի միջնորդության դեմ առարկություն է ներկայացրել: Արա Բուդաղյանն ասել է, որ իրեն ազատ արձակեն, քանի որ ինքը թաքնվելու մտադրություն չունի: «Ընդ որում, նաեւ հաշվի առնենք, որ դեպքը տեղի է ունեցել մայիսի 20-ին, մինչեւ հուլիսի 3-ը Արա Բուդաղյանը եղել է ազատության մեջ, ու քննիչի չի կարողանում ներկայացնել մի փաստ, որ այդ ընթացքում Արա Բուդաղյանը փորձել է թաքնվել կամ խոչընդոտել է քննության ընթացքին»,-պատասխանեց Ալումյանը:
