ՊԵԿ հարկային տեսուչի կողմից պաշտոնեական դիրքը չարաշահելու դեպքի առթիվ քրգործ է հարուցվել

ՀՀ հատուկ քննչական ծառայությունում քրեական գործ է հարուցվել ՀՀ ԿԱ պետական եկամուտների կոմիտեի հարկային ծառայության աշխատակցի կողմից առերևույթ պաշտոնեական լիազորությունները չարաշահելու վերաբերյալ ՊԵԿ ներքին անվտանգության վարչությունից ստացված նյութերի և Տ. Վ.-ի հաղորդման առթիվ: Այս մասին Past.am-ին տեղեկացրին ՀՔԾ լրատվական ծառայությունից:

Այսպես, Տ. Վ.-ն ՀՀ հատուկ քննչական ծառայությունում հաղորդում է տվել, որ իր ընկերության կողմից օրենսդրությամբ նախատեսված հարկային պարտավորությունների կատարման ճշտության ստուգման ընթացքում ՊԵԿ գլխավոր հարկային տեսուչը 2017 թվականի հոկտեմբերի սկզբներին ընկերությունից, ի թիվս այլ փաստաթղթերի, պահանջել և ստացել է 2013-2015թթ.-ին իրականացված հաշվապահական հաշվառմանը վերաբերող փաստաթղթերը: Ըստ Տ. Վ.-ի` հիշյալ հարկային տեսուչը, խախտելով օրենսդրական պահանջները, նշված փաստաթղթերը ժամանակավորապես վերցնելու վերաբերյալ արձանագրություն չի կազմել, իսկ հետագայում հրաժարվել է դրանք ետ վերադարձնել` պատճառաբանելով, որ այդպիսիք իր կողմից չեն վերցվել: 

Որոշ ժամանակ հետո` 13.11.2017թ.-ին, գլխավոր հարկային տեսուչների կողմից կազմված ստուգման ակտով հիշյալ կազմակերպությանն առաջադրվել են ավելի քան 7 մլն ՀՀ դրամի չափով չկատարած հարկային պարտավորություններ, ընդ որում նաև` 2013-2015թթ.-ի շահութահարկի և ավելացված արժեքի հարկի մասով: Մինչդեռ, Տ. Վ.-ի վստահեցմամբ, վերը նշված փաստաթղթերի բացակայության պայմաններում ստուգվող կազմակերպության ներկայացուցիչները հնարավորություն չեն ունեցել օգտվել ստուգման ակտում արձանագրված դրույթների վերաբերյալ հիմնավորված հակափաստարկներ և առարկություններ ներկայացնելու` օրենքով վերջիններիս վերապահված իրավունքից:

 Այսպիսով, ՀՀ ԿԱ պետական եկամուտների կոմիտեի պետական հատուկ ծառայություն իրականացնող պաշտոնատար անձի կողմից պաշտոնեական դիրքը չարաշահելու վերը նշված դեպքի առթիվ ՀՀ հատուկ քննչական ծառայությունում քրեական գործ է հարուցվել ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 1-ին մասով:

Կատարվում է նախաքննություն:

 Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
