Ընկերության անվանումը փոխվել է, իսկ Բերբերյանի մոր բաժնեմասը հայտարարագրվել․ Էթիկայի հանձնաժողովի պարզաբանումը

Ավելի քան մեկ ամիս առաջ «Հետք» էլեկտրոնային լրատվամիջոցն իր՝ «Նախագահի օգնականը Արզնիում գարեջրի գործարան և ռեստորան է կառուցելու» հրապարակման (http://hetq.am/arm/news/84963/) մեջ նշել էր, որ ՀՀ նախագահի օգնական Ավետիս Բերբերյանի մայրը՝ Եղիսաբեթ Շմավոնյանը, 2015 և 2016 թթ․ տարեկան հայտարարագրերում չի հայտարարագրել «Բիթեր Ռիվեր» ՍՊ ընկերությունում իր ունեցած բաժնեմասը:
Սրա հետ կապված Բարձրաստիճան պաշտոնատար անձանց էթիկայի հանձնաժողովն այսօր պարզաբանում է հրապարակել։
Ինչպես Past.am-ը տեղեկացավ ethics.am կայքից՝ «Հանրային ծառայության մասին» ՀՀ օրենքի 34-րդ հոդվածի համաձայն՝ հայտարարատու պաշտոնատար անձի ընտանիքի կազմի մեջ մտնող անձի հայտարարագիրը պետք է ներառի նրան սեփականության իրավունքով պատկանող արժեթուղթը և (կամ) այլ ներդրումը, եթե հարկային տարում արժեթղթերի ձեռքբերման և այլ ներդրման կամ օտարման գործարքների ընդհանուր արժեքը գերազանցել է 8 միլիոն դրամը:
Ըստ պարզաբանման՝ Բերբերյանի ծնողի 2015 թ․ տարեկան հայտարարագրում հայտարարագրել է «Դառը գետ» ՍՊ ընկերությունում իր ունեցած բաժնեմասը՝ 50 հազար դրամի չափով, թեև վկայակոչված օրինադրույթի համաձայն՝ պարտավոր չէր հայտարարագրել այն, քանի որ տվյալ բաժնեմասի ձեռքբերման գինը չէր գերազանցում 8 միլիոն դրամը:
Համաձայն ՀՀ ԱՆ իրավաբանական անձանց պետական ռեգիստրի պաշտոնական կայքէջի քաղվածքի՝ «Դառը գետ» ՍՊ ընկերությունը 2016թ. անվանափոխվել է «ԲԻԹԵՐ ՌԻՎԵՐ» ՍՊ ընկերության, հետևաբար՝ «ԲԻԹԵՐ ՌԻՎԵՐ» ՍՊԸ-ում իր ունեցած բաժնեմասի վերաբերյալ Եղիսաբեթ Շմավոնյանը լրացրել է տվյալներ 2015 թ․ հայտարարագրում:
««Հանրային ծառայության մասին» օրենքին համապատասխան՝ Եղիսաբեթ Շմավոնյանը 2016 թ․ հայտարարագրում «ԲԻԹԵՐ ՌԻՎԵՐ»-ում իր ունեցած բաժնեմասի կամ ընկերության անվանափոխման մասին տվյալներ պարտավոր չէր լրացնել, քանի որ տվյալ տարվա ընթացքում բաժնեմասի ձեռքբերման կամ օտարման գործարք չի կատարվել, իսկ ընկերության անվանափոխման վերաբերյալ տվյալը հայտարարագրում արտացոլելու պահանջ սահմանված չէ»,- ասված է պարզաբանման մեջ:
