Դրամական միջոցների կամ գույքի արգելանքն այլևս չի «խանգարի» մաքսազերծմանը
SOCIETYՄինչ այժմ դրամական միջոցների կամ գույքի վրա արգելանք կիրառելու դեպքում խնդիրներ էին ծագում պարտապանի՝ ապրանքների մաքսազերծման գործում: Խնդիրը կարգավորելու նպատակով նախագիծ է մշակվել և շրջանառության դրվել Իրավական ակտերի նախագծերի հրապարակման միասնական կայքում: Նախագիծն այստեղ հայտնվել է այսօր:
««Դատական ակտերի հարկադիր կատարման մասին» ՀՀ օրենքում լրացում կատարելու մասին» օրենքի նախագծով սահմանվել է, որ պարտապանի գույքի վրա արգելանք դնելը չի խոչընդոտում պարտապանի կողմից իրականացվող հայտարարագրման գործընթացը՝ բացառությամբ այն դեպքի, երբ արգելանքը կիրառված է արտահանվող ապրանքի նկատմամբ:
Մինչ այս, կառավարության 2016 թ. հունվարի 29-ի «ՀՀ ֆինանսների նախարարության մաքսային ծառայության և արդարադատության նախարարության դատական ակտերի հարկադիր կատարումն ապահովող ծառայության միջև էլեկտրոնային եղանակով տեղեկատվության փոխանակման կարգը հաստատելու մասին» թիվ 54-Ն որոշման հավելվածի 2-րդ կետով սահմանված է եղել, որ հարկադիր կատարման ծառայության կողմից պարտապանի առկա և հետագայում ձեռք բերվելիք գույքի վրա արգելանք դնելու մասին որոշումները մաքսային ծառայություն են ուղարկվում մաքսային ծառայությունում ներդրված համապատասխան ծրագրի միջոցով՝ էլեկտրոնային եղանակով:
Նույն հավելվածի 6-րդ կետի համաձայն՝ հարկադիր կատարման ծառայության կողմից արգելանք դրվելու հետևանքով կասեցված գործարքի հետագա մաքսային ձևակերպումները թույլատրելու մասին որոշման ընդունման դեպքում մաքսային ծառայություն է ուղարկվում գործարքը թույլատրելու վերաբերյալ հաղորդագրություն:
Փաստորեն, ներկայումս ստեղծվել է մի իրավիճակ, երբ հարկադիր կատարման ծառայության կողմից պարտապանի առկա և հետագայում ձեռք բերվելիք գույքի վրա արգելանք դրված լինելու հանգամանքը գործնականում հիմք է հանդիսանում հետագա մաքսային ձևակերպումները կասեցնելու համար, ինչի հետևանքով անձը կարող է վնասներ կրել: Այնինչ, արգելանքի առկայությունը, ինքնին, չպետք է խոչընդոտ հանդիսանա մաքսային հայտարարագրման գործընթացն իրականացնելու համար: Նախագծի հեղինակ ՀՀ արդարադատության նախարարության «Օրենսդրության զարգացման և իրավական հետազոտությունների կենտրոն» հիմնադրամը որոշել է մարդկանց «զրկել» կամ հեռու պահել այդ վնասներից՝ կատարելով այս լրացումը «Դատական ակտերի հարկադիր կատարման մասին» օրենքում՝ հավելելով, որ «... նախագծի ընդունման արդյունքում կվերանան անձի գույքի կամ դրամական միջոցների արգելանքի առկայության դեպքում ապրանքների մաքսազերծման՝ գործնականում առաջացող խոչընդոտները»:
