Ժամը 22.00-ից հետո հրավառություններ չեն լինի
SOCIETYԱԺ տարածքային կառավարման, տեղական ինքնակառավարման, գյուղատնտեսության և բնապահպանության հարցերի մշտական հանձնաժողովում հրավառությունների կարգավորմանն ուղղված 2-րդ ընթերցմանը ներկայացվող նախագծերի քննարկման ժամանակ ընդունվել է հրավառության նյութերը բացառապես իրավաբանական անձանց վաճառելու առաջարկը:
Սա նշանակում է, որ օրենքի ընդունումից հետո ֆիզիկական անձանց այլևս կարգելվի հրավառության նյութեր և պարագաներ վաճառել, իսկ խնջույքներ կազմակերպող իրավաբանական անձինք հրավառություն անելու նյութերը կգնեն միայն համայնքի կողմից թույլտվություն ստացած իրավաբանական անձանցից:
ՏԻՄ-ի կողմից տրված տարեկան թույլտվության հիման վրա կազմակերպությունները հրավառություն կկարողանան իրականացնել իրենց մասնավոր տարածքում՝ օրվա հստակ ժամին:
Առանց թույլտվության հրավառության նյութերի վաճառքը իրականացնելու դեպքում կսահմանվի տուգանք՝ նվազագույն աշխատավարձի 250-ապատիկի չափով, իսկ թույլտվության վճարի չափը կորոշի ամեն համայնքի ավագանին: Միևնույն ժամանակ, նախատեսվում է, որ թույլտվության տարեկան վճարը կտատանվի 50-300 հազար ՀՀ դրամի սահմաններում, իսկ առանց թույլտվության հրավառություն իրականացնողը կտուգանվի սկզբում 300 հազարից -1 մլն ՀՀ դրամով, երկրորդ անգամ՝ 1 մլն 300 հազարից - 2մլն դրամով:
ԱԺ ԵԼՔ խմբակցության պատգամավոր Լենա Նազարյանը Past.am-ի հետ զրույցում անդրադառնալով օրենսդրական նախաձեռնությամբ տարեկան թույլտվություն ստանալու վճարի մինիմում և մաքսիմում սահմաններին, նշեց, որ վճարի չափը հաստատում է ավագանին, կախված վայրից, այն կարող է տարբեր լինել: Հարցին, թե արդյո՞ք թույլտվության վճարի չափի նման ահռելի տարբերությունը չի նշանակի կոռուպցիոն ռիսկեր պարունակել, և ի սկզբանե անհավասար մեկնարկային պայմաններ ստեղծել տարբեր իրավաբանական անձանց համար, պատգամավորը պատասխանեց.
«Չի բացառվում, նաև, որ օրենքն ընդունվի ու չաշխատի, բայց առաջին քայլը միշտ օրենք ընդունելն է: Առանց այս օրենքի ոստիկանության, ինչպես նաև տեղական ինքնակառավարման մարմինների աշխատանքն անօրինական կլիներ: Ինչ վերաբերում է այլ վայրում գրանցվելուն և Երևանում գործունեություն ծավալելուն, ապա ով է խանգարում մարզում գրանցվել և օրինակ՝ մայրաքաղաքում գործունեություն ծավալել: Ի դեպ համայնքից թույլտվություն ստանալու վճարի չափն առաջարկվել է նախագիծը ներկայացնողների կողմից: Ամեն դեպքում, նման օրենք ընդունելու հանրային պահանջը մեծ է թե համայնքի ղեկավարության և թե՛ հասարակության կողմից: Ես ենթադրում եմ, որ շատ շուտով ժամը 22.00-ից հետո այլևս հրավառություններ չեն լինի: Մնում է, որ այս գործով զբաղվողները նույնպես տեղեկացված լինեն, որպեսզի ֆիզիկական և իրավաբանական անձինք օրենքի մասին անտեղյակության պատճառով չընկնեն ավելորդ տույժերի և տուգանքների տակ»,- ասաց պատգամավորը:
