Դավիթ Հարությունյանը հիմնավորեց սահմանադրական բարեփոխումների գործընթացին ՍԴ նախագահի և վարչապետի մասնակցության օրինականությունը

Կառավարության աշխատակազմի ղեկավար-նախարար Դավիթ Հարությունյանը համաձայն չէ ընդդիմադիրների այն տեսակետի հետ, թե Սահմանադրական դատարանի նախագահն իրավունք չունի մասնակցել սահմանադրական բարեփոխումների գործընթացին: Ազգային ժողովում լրագրողների հետ զրույցում Դավիթ Հարությունյանը նշեց, որ սահմանադրական դատարանի նախագահը հ ենց այդ ոլորտի մասնագետ է, ով ունի հարուստ փորձ ու պետք է մասնակցի այդ գործընթացին: «Եթե խոսքը վերաբերեր այն հանգամանքին, որ նրան հնարավորություն է տրվում իրավական պարտավորեցնող մի ակտ ընդունել, ես համաձայն կլինեի այդ տեսակետի հետ: Իրավական պարտավորեցնող ակտ ընդունելու դեպքում լրիվ այլ իրավիճակ կլիներ: Սակայն, երբ խոսքը գնում է փաստաթղթի մշակմանը, որը պետք է դառնա քննարկման առարկա և հետագայում հանրաքվեի դրվի, ես չեմ կարող նման տեսակետի հետ համաձայն լինել»,- նշեց Հարությունյանը:

Հարցին, թե եթե հանրաքվեից հետո ընդդիմությունը որոշի դիմել Սահմանադրական դատարան, որքանո՞վ օբյեկտիվ կստացվի քննությունը, եթե սահմանադրական դատարանի նախագահը մասնակցել է փաստաթղթի նախապատրաստման գործընթացին, Դավիթ Հարությունյանը պատասխանեց. «Հանրաքվեի արդյունքները Սահմանադրական դատարանում չեն կարող վիճարկվել բովանդակային հիմքով, այլ կարող են վիճարկվել միայն քվեարկության ժամանակ տեղի ունեցած հնարավոր խախտումներով: Եվ մեկը մյուսի հետ որևէ առնչություն չունի: Այսինքն, եթե կան խախտումներ, քննվում է խախտումների հարցը, բովանդա կության մասին չէ խոսքը»,- հավելեց կառավարության աշխատակազմի ղեկավարը:

Դավիթ Հարությունյանը համաձայն չէ հնչող տեսակետի հետ, թե «այո»-ի քարոզչության ղեկավարի պաշտոնում ՀՀ վարչապետ Հովիկ Աբրահամյանի նշանակումը խոսում է այն մասին, որ իշխանությունները վարչական ռեսուրս են կիրառելու: «Որևէ երկրում արգելված չէ, որ մարդը ոչ ի պաշտոնե քարոզչություն իրականացնի: Եթե նա ասի «ես՝ որպես Հայաստանի վարչապետ, հորդորում եմ բոլորիդ գնալ և կողմ քվեարկել», դուք այդ դեպքում իրավացի կլինեք: Եթե նա այդ նույն կոչն անի ոչ թե որպես վարչապետ, այլ «այո»-ի շտաբի ղեկավար, դա արդեն չի կարող կոչվել վարչական ռեսուրսի կ իրառում որևէ երկրում: Օրինակ, եթե նայում ենք ԱՄՆ-ի փորձը, ապա տեսնում ենք, որ երբ քաղաքական պայքարին մասնակցող շերիֆը հանդես է գալիս իր համազգեստով, համարում են, որ նա վարչական ռեսուրս է օգտագործում: Եթե շերիֆը իր վրայից հանում է իր համազգեստը և չի ասում, որ ինքն այդ պահին որպես շերիֆ է խոսում, դա արդեն վարչական ռեսուրսի կիրառում չի համարվում: Եվ նույն մոտեցումը որդեգրել են բոլոր երկրները: Հակառակ դեպքում՝ քաղաքական անձինք քաղաքական գործընթացին մասնակցելու հնարավորություն չեն ունենա, իսկ ընտրությունները, հանրաքվեն գործընթաց են: ՑանկացաÕ ® քաղաքական պաշտոնյա առաջին հերթին մասնակցում է նման գործընթացիներին»,- եզրափակեց Հարությունյանը՝ շեշտելով, որ Հովիկ Աբրահամյանը «այո»-ի շտաբի նիստերը վարում է ոչ թե որպես հանրապետության վարչապետ, այլ որպես շտաբի ղեկավար:

Նա չհամաձայնեց նաև դիտարկման հետ, թե հանրաքվեից առաջ «այո»-ի և «ոչ»-ի կողմնակիցների համար անհավասար պայմաններ են ստեղծված: Նրա խոսքով՝ անհավասար պայմանների մասին կարելի կլիներ խոսել այն դեպքում, երբ ԶԼՄ-ները առանձնակի ուշադրություն կդարձնեին «այո»-ի քարոզարշավին, իսկ «ոչ»-ի քարոզարշավին ուշադրություն չէին դարձնի:
