Դատավորի՝ վարձով մնալու գումարը կփոխհատուցի պետությունը
SOCIETYԱրդարադատության նախարարության «Օրենսդրության զարգացման և իրավական հետազոտությունների կենտրոն» հիմնադրամի կողմից մշակվել է նախագիծ դատավորի՝ իր մշտական բնակության վայրից դուրս նշանակման դեպքում բնակարանի վարձի փոխհատուցում ստանալու մասին:
Միաժամանակ սահմանվել են Բարձրագույն դատական խորհրդի սահմանած դեպքերում իր մշտական բնակության վայրից դուրս պաշտոնի նշանակված դատավորին իր դիմումի հիման վրա տվյալ վայրում բնակարանի վարձին համարժեք փոխհատուցում տրամադրելու կարգը, առավելագույն չափն ու ժամկետը:
Արդեն իսկ գործող օրենսդրությամբ համանման սոցիալական երաշխիքներ ամրագրված են պատգամավորի և կառավարության անդամի համար:
Մասնավորապես, «Հայաստանի Հանրապետության Ազգային ժողովի պատգամավորի գործունեության երաշխիքների մասին» օրենքի 9-րդ հոդվածի համաձայն՝ Երևան քաղաքում բնակարան չունեցող պատգամավորին տրվում է բնակարանի վարձին համարժեք փոխհատուցում, իսկ «Կառավարության կառուցվածքի և գործունեության մասին» օրենքի 17-րդ հոդվածի 1-ին մասի համաձայն՝ կառավարության սահմանած դեպքերում իր մշտական բնակության վայրից դուրս պաշտոնի նշանակված կառավարության անդամի դիմումի հիման վրա տրամադրվում է տվյալ վայրում բնակարանի վարձին համարժեք փոխհատուցում: Փոխհատուցման առավելագույն չափը Ազգային ժողովի նախագահի որոշմամբ ընտրվել է 100 հազար դրամը:
Այս որոշման նախագծով ամրագրվում են դատավորի կողմից դիմումին կից ներկայացվող փաստաթղթերը, սահմանվում է 100 հազար դրամի չափով փոխհատուցման առավելագույն չափ, նախատեսվում է, որ փոխհատուցումը տրամադրվում է առավելագույնը երկու տարի ժամանակահատվածի համար և ամրագրվում են փոխհատուցման տրամադրման դադարեցման դեպքերը:
Նախագծի ընդունման դեպքում ակնկալվում է կարգավորել Բարձրագույն դատական խորհրդի սահմանած դեպքերում իր մշտական բնակության վայրից դուրս պաշտոնի նշանակված դատավորին իր դիմումի հիման վրա տվյալ վայրում բնակարանի վարձին համարժեք փոխհատուցում տրամադրելու կարգի, առավելագույն չափի ու ժամկետի հետ կապված հարաբերությունները:
