Կկայանա Անդրիաս Ղուկասյանի դատական նիստը. դատավորի որոշման վրա ազդեցություն կունենա՞ նոր քաղաքական իրավիճակը
POLITICSԱյսօր ժամը 15:30-ին Էրեբունի և Նուբարաշեն վարչական շրջանի առաջին ատյանի դատարանում կայանալու է ընդդիմադիր քաղաքական գործիչ Անդրիաս Ղուկասյանի խափանման միջոցը փոխելու վերաբերյալ դատական նիստը:
«Ռադիո Հայ» ռադիոկայանի համահիմնադիր Անդրիաս Ղուկասյանն արդեն 21 ամիս է շարունակում է մնալ անազատության մեջ: Հիշեցնենք, որ սրանից մոտ երկու տարի առաջ՝ 2016 թվականի հուլիսի 31-ին Ղուկասյանըկալանավորվեց Սարի թաղում զանգվածային անկարգություններ կազմակերպելու մեղադրանքով:
Անդրիաս Ղուկասյանի կինը՝ Անահիտ Թարխանյանը, Past.am-ի այն հարցին, թե երկրում տեղի ունեցող քաղաքական իրադարձությունները կարո՞ղ են անդրադառնալ դատավորի որոշման վրա պատասխանեց, թե դժվարանում է ասել: Բայց և հիշեցրեց, որ գործն արդեն Եվրոպական դատարանում է, ՄԻԵԴ-ը սկսել է հարցի ուսումնասիրումը: Իրենք էլ սպասում են ՄԻԵԴ-ի որոշմանը:
Հարցին, թե ի՞նչ է ակնկալում այսօր կայանալիք դատական նիստից առհասարակ, նշեց. «Միայն լավ նորություններ: Բոլոր դեպքերում, որքան էլ չուզենան այսօրվա՝ արդեն նախկին իշխանությունները, դատավորները, քննիչներն ու դատախազները, որքան էլ աչք փակեն, հանրապետությունում ստեղծված իրավիճակը, միանշանակ, բոլորի վրա ազդում է, և մենք մեծ հույսեր ենք կապում, որ ամեն ինչի հետ միասին կունենանք դրական որոշում»:
Չորս շաբաթ առաջ տեղի էր ունեցել Անդրիաս Ղուկասյանի գործով Վճռաբեկ դատարանի դատական նիստը, որտեղ սահմանվել էր, որ ինն ամիս շարունակ Անդրիաս Ղուկասյանն անօրինական է կալանքի տակ եղել: Դատավորը նրան կալանքի տակ պահելու որոշում չէր կայացրել: Այս սահմանադրական խնդրի լուծման նպատակով Վճռաբեկ դատարանը դիմել է Սահմանադրական դատարան:
Թարխանյանը ևս մեկ դրական քայլ է համարում այն, որ իրենք ի վերջո հնարավորություն ստացան դիմել դատարան՝ Անդրիաս Ղուկասյանի խափանման միջոցը փոխելու համար:
Շարժման օրերին Նիկոլ Փաշինյանն անձամբ հայտարարել էր, որ պետք է ազատ արձակվեն բոլոր քաղբանտարկյալները: Սա, թերևս, շատ-շատերին է ոգևորել: Եթե այս խոսքերը գործի վերածվեն, ապա Անդրիաս Ղուկասյանը, ով այսօր այդ շարքերում առաջիններից է, կարող է ազատ արձակվել:
Մեր դիտարկմանը, թե այսօր բացասական որոշում լսելու դեպքում, Անահիտ Թարխանյանն իր հույսը կկապի՞ Նիկոլ Փաշինյանի այդ հայտարարության հետ, զրուցակիցս պատասխանեց, որ չի ցանկանում Անդրիասի ազատությունը տվյալ պահին ինչ-որ «ենթա»-ների տակ դնել. «Տեսնենք, թե այսօր ինչ տեղի կունենա, իրականությունն ավելի հստակ կլինի»:
