ԵՐԵՎԱՆ, 19 ՄԱՅԻՍԻ, ԱՐՄԵՆՊՐԵՍ: ՀՀ վարչապետ Նիկոլ Փաշինյանը ֆեյսբուքյան ուղիղ միացմամբ խոսել է դատական համակարգի խնդիրների մասին և ներկայացրել դրանց լուծման ուղիները: «Արմենպրես»-ի հաղորդմամբ` Նիկոլ Փաշինյանը ընդգծել է, որ ՀՀ իշխանության որևէ ներկայացուցիչ հրահանգ չի տալու դատարաններին այս կամ այն որոշումը կայացնելու հարցում:

 

«Դա ինձ համար կարմիր գիծ է, և չեմ կարող թույլ տալ, որ մեր իշխանության որևէ ներկայացուցիչ հատի այդ կարմիր գիծը, որովհետև անկախ դատական համակարգ ունենալու համար պետք է ապահովել երկու բան` առաջինը հնարավորություն տալ դատավորներին իրենց լիազորությունների շրջանակներում կայացնել որոշումներ և երկրորդ` փակենք նրանց կողմից կաշառքով հարցեր լուծելու բոլոր ճանապարհները»,- ասաց Փաշինյանը:

 

Վարչապետը հուսով է, որ հասարակությունը կպաշտպանի այդ մոտեցումը:

 

Նրա խոսքով` ներկայումս օրենսդրությամբ ՀՀ դատավորները գործունեության որոշակի երաշխիքներ ունեն և նրանք պետք այդ երաշխիքներից օգտվեն` ցանկացած գործով կայացնեն օբյեկտիվ դատավճիռ՝ հիմք ընդունելով իրենց ձեռքի տակ եղած ապացույցները:

 

«Ես ուզում եմ հստակ արձանագրել, որ Հայաստանում որևէ մեկը իրավունք չունի դատական համակարգի գործերին միջամտել, նույնիսկ դատական համակարգի ներսի մարդիկ և դատավորները, եթե իրենք իրենց վրա վերցրել են պատասխանատվություն ստանձնելու այդ պաշտոնը, ուրեմն պետք է վերցնեն պատասխանատվություն կայացնելու վճիռներ»,-ասաց Փաշինյանը՝ նաև անդրադառնալով կալանքը որպես խափանման միջոց կիրառելու պրակտիկային: Նրա կարծիքով` այն դեպքերում, երբ արդարացված չէ կալանավորումը պետք է անձանց կալանքից ազատել:

 

«Պետք է խուսափել այն վիճակից, երբ կալանավայրերում լեփ-լեցուն է և որտեղ կալանավորները հերթով են քնում: Սրանք ուղղակի խոշտանգման երևույթներ են, և ուզում եմ հստակ ուշադրություն դարձնել այս խնդրի վրա: Ես պաշտպանում եմ Արդարադատության նախարարի դիրքորոշումը. այն է՝  կալանավորների թիվը չպետք է գերազանցի կալանավայրերում քնելու տեղերին»,- ընդգծեց Փաշինյանը:
