Ի պատասխան Ձեր 22.05.2018 թվականի 5/Ե-17 գրության՝ տեղեկացնում եմ, որ Հայաստանի Հանրապետության Սահմանադրության 95-րդ հոդվածը հստակ սահմանում է պատգամավորական մանդատի անհամատեղելիության դեպքերը, համաձայն որի «պատգամավորը չի կարող զբաղեցնել իր կարգավիճակով չպայմանավորված պաշտոն պետական կամ տեղական ինքնակառավարման այլ մարմիններում», իսկ «Ազգային ժողովի կանոնակարգ» ՀՀ Սահմանադրական օրենքի 155-րդ հոդվածը սահմանում է պատգամավորի հրաժարական տալու կարգը, ժամկետները և լիազորությունները դադարելու պահը, մասնավորապես.

«Եթե հրաժարականի հրապարակումից հետո` մեկ շաբաթվա ընթացքում, պատգամավորը գրավոր դիմումով` 

1) հետ է վերցնում հրաժարականի մասին իր դիմումը, ապա Ազգային ժողովի նախագահն այդ մասին հանդես է գալիս հայտարարությամբ.

2) հետ չի վերցնում հրաժարականի մասին իր դիմումը, ապա նրա լիազորությունների դադարման մասին կազմվում է արձանագրություն, որն ստորագրում և հրապարակում է Ազգային ժողովի նախագահը: Արձանագրության հրապարակման պահից հրաժարականը համարվում է ընդունված:»

«Երևան քաղաքում տեղական ինքնակառավարման մասին» ՀՀ օրենքի 20-րդ հոդվածով սահմանվում է Երևանի ավագանու անդամի լիազորությունների վաղաժամկետ դադարեցման դեպքերը և ընթացակարգը։ 

2018 թվականի մայիսի 16-ին Կենտրոնական ընտրական հանձնաժողովի N6 արձանագրությամբ Ձեզ տրամադրվել է Ազգային Ժողովի պատգամավորի մանդատ, ուստի նշված օրվանից առ այսօր առկա է Ազգային Ժողովի պատգամավորի մանդատի անհամատեղելիություն, քանի, որ ԱԺ պատագամավորի պաշտոնից հրաժարվելու վերաբերյալ ԱԺ նախագահին ուղղված Ձեր դիմումը, հիշատակված օրենքի համաձայն, չի նշանակում հրաժարականը ընդունված և Դուք շարունակում եք զբաղեցնել ԱԺ պատգամավորի պաշտոնը: 

Հուսով եմ քաջածանոթ լինելով այս իրավակարգավորումներին, Դուք նաև տեղյակ եք, որ մեկ շաբաթից ավել միաժամանակ զբաղեցնելով Հայաստանի Հանրապետության Սահմանադրությամբ անհամատեղելի համարվող երկու պաշտոններ, Ձեր ավագանու անդամի լիազորությունները վաղաժամկետ դադարեցվում են օրենքի ուժով, իսկ Երևանի քաղաքապետի կողմից դրա վերաբերյալ արձանագրություն (24.05.2018թ. N4) կազմելն ու ուղարկելը կենտրոնական ընտրական հանձնաժողով ուղղակի պարտավորություն է, իսկ դրա չիրականացնելը օրենքի խախտում:

Շնորհավորում եմ Ձեզ Ազգային ժողովի պատգամավորի լիազորությունների ստանձնման կապակցությամբ և շնորհակալություն եմ հայտնում այս մեկ տարվա ընթացքում Երևանի ավագանու աշխատանքներում Ձեր ունեցած ներդրման համար։ Դուք մշտապես հետաքրքիր հարցեր եք բարձրացրել մեր քննարկումներում և իհարկե լիահույս եմ, որ ՀՀ Ազգային Ժողովում կշարունակեք Ձեր ակտիվ գործունեությունը՝ չմոռանալով իհարկե բարձրաձայնել Երևանի հոգսերի և բարեփոխումների մասին: 

Հուսով եմ, որ Ձեր փոխարեն Երևանի ավագանի մուտք կգործի նույնչափ բանիմաց և սրտացավ քաղաքացի, որն իր ներդրումը կունենա և մասնակիցը կլինի Երևանի զարգացման և շենացման միասնական գործին։
