Նոր իրողությունների «հնարավորությունները»

Բանը հասել ա նրան, որ մեր հանրապետությունում արդեն հենց այս պահին կա անձ, որն իրեն համարում է երկու մանդատի իրավատեր, այսինքն մարդը և՛ ԱԺ պատգամավոր է, և՛ Երևանի ավագանու անդամ։
Սկսենք Հայաստանի Հանրապետության սահմանադրությունից։ Նման մտայնությունների ու ցանկությունների առկայության գաղափարն ըստ էության հիպոթետիկ առումով հաշվի է առնվել սահմանադրագետների կողմից, և հետևաբար դրանք թույլ չտալու համար Սահմանադրության 95-րդ հոդվածով հստակ սահմանվել են ՀՀ ԱԺ պատգամավորի մանդատի անհամատեղելիության պայմանները, այն է՝ «պատգամավորը չի կարող զբաղեցնել իր կարգավիճակով չպայմանավորված պաշտոն պետական կամ տեղական
ինքնակառավարման այլ մարմիններում»։
Միգուցե մեր օրենսդիրները մտածել են նաև օրենքների հետ աճպարարություն անել ցանկացողների մասին և, հետևաբար, սահմանադրական օրենք համարվող ՀՀ Ազգային ժողովի կանոնակարգով սահմանել են պատգամավորի հրաժարական տալու կարգը, ժամկետները և հրաժարականի ընդունման պահը (Հոդված 155)։
Ըստ երևույթին մեր օրենսդիրներն այնքան խորն են գնացել երկմանդատության ցանկություն ունեցող անձի հայտնվելու հիպոթեզում, որ փորձել են հստակեցնել խնդիրը նաև Տեղական ինքնակառավարման մասին և Երևան քաղաքում տեղական ինքնակառավարման մասին ՀՀ օրենքներում՝ սահմանելով ավագանուանդամի լիազորությունների վաղաժամկետ դադարեցման պայմանները։
Արդյունքում՝ պետք է արձանագրենք, որ նմանօրինակ հաճույք ստանալու սիրահարների համար, ցավոք սրտի, մեր օրենսդրությունը չի ստեղծել նպաստավոր պայմաններ և որևէ կերպ չի թույլատրում տվյալ երկու մանդատների միաժամանակյա տնօրինումը մեկ անձի կողմից Հայաստանի Հանրապետության սահմաններում։
Ինքը, տվյալ դեպքում՝ ՀՀ հպարտ քաղաքացի Ալեն Սիմոնյանն ըստ երևույթին արդեն կամաց-կամաց հասկանում է ստեղծված իրողության անլրջությունը և իհարկե հասկանալով, որ ոչինչ հավերժ չէ այս երկնքի տակ, կմնա ՀՀ Ազգային ժողովում ու ետ կվերցնի իր դիմումը, քանի որ Երևանի ավագանու անդամի լիազորությունները դադարեցվել են ՀՀ օրենսդրության ամբողջ ուժով։
