ՀՀ դատախազությունը ընդերքօգտագործողների կողմից շուրջ 270 մլն դրամ ներդրման պարտավորություն չկատարելու փաստեր է հայտնաբերել

ՀՀ գլխավոր դատախազության պետական շահերի պաշտպանության վարչությունը ուսումնասիրության է ենթարկել ՀՀ էներգետիկ ենթակառուցվածքների և բնական պաշարների նախարարությունում ընդերքօգտագործողների կողմից համայնքներում սոցիալ-տնտեսական զարգացման ոլորտներում ներդրումներ իրականացնելու գործընթացը: Այս մասին «Արմենպրես»-ին տեղեկացրին ՀՀ դատախազության հանրային կապերի բաժնից: 

 

Ընդերքի մասին նոր օրենսգրքի ուժի մեջ մտնելուց հետո, 2012 թվականի հունվարի 1-ից սկսած, ՀՀ էներգետիկ ենթակառուցվածքների և բնական պաշարների նախարարության հետ կնքվող ընդերքօգտագործման բոլոր պայմանագրերում նախատեսվել է համայնքի սոցիալ-տնտեսական զարգացման ոլորտում ներդրումներ իրականացնելու պարտավորություն: Համաձայն պայմանագրերի՝ նշված ներդրումների իրականացման համար սահմանվել են տարբեր ուղղություններ և եղանակներ: Մասնավորապես, առկա են ինչպես ամեն տարի ֆինանսական օգնություն ցույց տալու պարտավորություններ (համայնքի դպրոցին, մանկապարտեզին, գրադարանին, զարգացման ծրագրերին և այլն), այնպես էլ ըստ անհրաժեշտության կամ մեկանգամյա ներդրում իրականացնելու պարտավորություն թե՛ ֆինանսական, թե՛ տեխնիկայի տրամադրման, թե՛ ապրանքների անհատույց տրամադրման կամ ինքնարժեքով իրացման եղանակներով: 

 

Ուսումնասիրությամբ պարզվել է, որ 2012-2017 թվականներին ընդերքօգտագործման պայմանագրերում նախատեսվել է համայնքներում ներդրումներ կատարելու պարտավորություն 417 ընդերքօգտագործողներից 86 սուբյեկտների համար: Նշված սուբյեկտները պայմանագիր կնքելուց հետո համայնքներում պայմանագիրը կնքելուց մինչև ուսումնասիրության ավարտն ընկած ժամանակահատվածն ընդհանուր առմամբ պարտավոր էին կատարել շուրջ 280,5 միլիոն դրամի ներդրում (հաշվարկում չի ներառվել բնեղեն եղանակով իրականացվող ներդրումները): ՀՀ դատախազության կողմից համայնքներին, մարզպետարաններին կատարած հարցումներից պարզվել է, որ ուսումնասիրության պահին ընդհանուր առմամբ կատարվել է շուրջ 10,7 միլիոն դրամի ներդրում կամ ընդհանուր ներդրումների 4 տոկոսը: 

 

Ուսումնասիրությամբ պարզվել է, որ շուրջ 53,3 միլիոն դրամի մասով արդեն լրացել է դատարան հայց ներկայացնելու հայցային վաղեմության եռամյա ժամկետը: 

 

Տարածքային դատախազությունների կողմից պարտավորությունը չկատարած տնտեսվարող սուբյեկտներին «Դատախազության մասին» ՀՀ օրենքով սահմանված կարգով ներկայացվել են նախազգուշացումներ ողջամիտ ժամկետում պարտավորությունները կատարելու համար: 

 

Բացի այդ, ՀՀ գլխավոր դատախազությունը գրությամբ դիմել է ՀՀ էներգետիկ ենթակառուցվածքների և բնական պաշարների նախարարությանը՝ հայտնաբերված խախտումների վերաբերյալ դիրքորոշում ներկայացնելու, արձանագրված շուրջ 270 միլիոն դրամի գանձման ուղղությամբ միջոցներ ձեռնարկելու նպատակով:
