Դատարանը հետաձգեց Գևորգ Սաֆարյանի կալանքը որպես խափանման միջոցը փոխելու վերաբերյալ պաշտպանի միջնորդության որոշման կայացումը

Վերաքննիչ դատարանում հունիսի 6-ին քննվեց 5 տարի 5 ամսով դատապարտված Գևորգ Սաֆարյանի կալանքը որպես խափանման միջոց փոխելու վերաբերյալ միջնորդությունը:

«Արմենպրես»-ի հաղորդմամբ` խորհրդակցական սենյակից վերադառնալուց հետո դատավոր Ռուզաննա Բարսեղյանըներկայացրեց դատարանի որոշումը.

«Ամբաստանյալ Գևորգ Սաֆարյանի նկատմամբ կիրառված խափանման միջոց կալանավորումը վերացնելու և այն ստորագրությամբ չհեռանալու մասին խափանման միջոցով փոխարինելու կամ նրա նկատմամբ որպես խափանման միջոց անձնական երաշխավորում կիրառելու վերաբերյալ միջնորդության լուծումը հետաձգել»:

Դատավորը նշեց, որ ներկայացված միջնորդությանը պետք է անդրադառնալ վերաքննիչ բողոքներին փաստարկներին անդրադառնալիս ու վերջնական դատական ակտ կայացնելիս:

Դատավոր Բարսեղյանը նշեց, որ առաջին ատյանի դատարանը նրան մեղավոր է ճանաչել մեղսագրվող արարքներում և պատիժ է նշանակել ազատազրկման ձևով, ինչը էականորեն բարձրացնում է նրա փախուստի հավանականությունը:

Ավելի վաղ, պաշտպան Տիգրան Եգորյանը նշել էր, որ Գևորգ Սաֆարյանի դրսևորած վարքագիծը, ինչպես նաև նրա հրապարակային հայտարարությունները, ակնհայտ են դարձնում այն հանգամանքը, որ նա չի հետապնդելու պատասխանատվությունից խուսափելու նպատակ:

«Այս կապակցությամբ մենք ունենք երկու խնդրանք` վերացնել Գևորգ Սաֆարյանի նկատմամբ կիրառված խափանման միջոցը, կիրառելով ստորագրությամբ չհեռանալու մասին խափանման միջոցը: Եթե չբավարարվի այդ միջնորդությունը, խնդրում եմ քննարկել նաև ԱԺ պատգամավորներ Հայկ Կոնջորյանի և Ալեն Սիմոնյանի կողմից տրված երաշխավորության հարցը»,- ասաց Եգորյանը:

 Մյուս պաշտպանները ևս միացան միջնորդությանը:

Մեղադրական կողմը նշել էր, որ Գևորգ Սաֆարյանի նկատմամբ կալանավորումը որպես խափանման միջոց կիրառելու մասին հիմքերը եղել են, միևնույն ժամանակ հարկ է համարում փաստել, որ նոր իրադարձության փոփոխման արդյունքում էապես նվազել են ամբաստանյալի կողմից նոր հանցագործություններ կատարելու հիմքերը, ուստի առարկություններ չունի միջնորդությանը:

Ազգային ժողովի «Ելք» խմբակցության պատգամավորներ Հայկ Կոնջորյանը և Ալեն Սիմոնյանը անձնական երաշխավորություն են ներկայացրել երկու տարով դատապարտված Գևորգ Սաֆարյանի խափանման միջոց կալանքը փոխելու վերաբերյալ:

Գևորգ Սաֆարյանին մեղադրանք էր առաջադրվել այն բանի համար, որ նա, մի խումբ անձանց հետ նախնական համաձայնությամբ, 2015 թվականի ապրիլի 24-ին Երևան քաղաքում բռնություն գործադրելով, գույք ոչնչացնելով և վնասելով, ինչպես նաև իշխանության ներկայացուցչին զինված դիմադրություն ցույց տալով արտահայտված, հասարակական անվտանգությունը վտանգող զանգվածային անկարգություններ հրահրելու ուղղակի դիտավորությամբ, սկսած 2014 թվականի մայիսից կատարել է դրա կազմակերպմանն ուղղված նախապատրաստական գործողություններ:
