ՓՊ-ն Տիգրան Աթանեսյանի նկատմամբ հարուցել է կարգապահական վարույթ

Քաղաքացի Վիլեն Մամիկոնի Գայֆեջյանի բողոքի և զանգվածային լրատվության միջոցների հրապարակումների հիման վրա ՀՀ փաստաբանների պալատի նախագահ Արա Զոհրաբյանը հունիսի 6-ի որոշմամբ փաստաբան Տիգրան Աթանեսյանի նկատմամբ հարուցվել է կարգապահական վարույթ` «Փաստաբանության մասին» ՀՀ օրենքի 19-րդ հոդվածի 2-րդ կետի և Փաստաբանի վարքագծի կանոնագրքի 2.2.3 ենթակետի պահանջների խախտման հատկանիշներով:

Այս մասին «Արմենպրես»-ին տեղեկացրին ՀՀ Փաստաբանների պալատի մամուլի ծառայությունից:

«Ըստ դիմողի և զանգվածային լրատվության միջոցների հրապարակումների՝ փաստաբան Տիգրան Աթանեսյանը հրապարակային հարթակներում վիրավորական գրառումներ (արտահայտություններ) և հայհոյանքներ է կատարել, ինչպես նաև կատարված հայհոյանքները և վիրավորական գրառումները կամ արտահայտություններն արդարացնելու և շարունակելու վարքագիծ է դրսևորել: ՀՀ փաստաբանների պալատի ընդհանուր ժողովի կողմից 11.02.2012թ. թիվ 1/4-Լ որոշմամբ հաստատված Փաստաբանի վարքագծի կանոնագրքի 2.2.3 ենթակետի համաձայն՝ մասնագիտական, հասարակական, հրապարակախոսական և այլ բնագավառներում իր գործունեությամբ փաստաբանը պետք է նպաստի փաստաբանի մասնագիտության բովանդակության և հասարակական կոչման նկատմամբ հարգանքի ձևավորմանն ու ամրապնդմանը:

Կարգապահական գործը հանձնվելու է ՀՀ փաստաբանների պալատի ընդհանուր ժողովի կողմից ընտրված կարգապահական գործ նախապատրաստող փաստաբանին, որի կողմից կազմվող եզրակացության հիման վրա ներկայացվելու է ՀՀ փաստաբանների պալատի խորհրդի քննությանը:

Միաժամանակ հիշեցնում ենք, որ փաստաբանի նկատմամբ կարգապահական վարույթ հարուցելն ինքնին չի նշանակում, որ փաստաբանը թույլ է տվել կարգապահական խախտում և այդ հարցի վերջնական պատասխանը կարող է տրվել միայն կարգապահական վարույթի իրականացման արդյունքում` Պալատի խորհրդի համապատասխան որոշմամբ»,- ասված է հաղորդագրության մեջ:
