«Գորիս» ՔԿՀ-ում տեղի ունեցած զանգվածային անկարգություններին մասնակցելու համար մեղադրանք է առաջադրվել 6 անձի

ՀՀ քննչական կոմիտեի հատկապես կարևոր գործերով քննության գլխավոր վարչությունում քննվող քրեական գործով պարզվել են ՀՀ արդարադատության նախարարության «Գորիս» քրեակատարողական հիմնարկում տեղի ունեցած անկարգություններին մասնակցած մի շարք անձանց ինքնությունը, անհատականացվել նրանցից յուրաքանչյուրի գործողությունները։ Մեղադրանք է առաջադրվել 6 անձի և նրանց մասով հայտարարվել նախաքննության ավարտի մասին:

Այս մասին տեղեկացրին ՀՀ քննչական կոմիտեից՝ հավելելով. «2017թ. հոկտեմբերի 30-ին՝ ժամը 15:30-ի սահմաններում, «Գորիս» քրեակատարողական հիմնարկում դատապարտյալների և կալանավորների մասնակցությամբ տեղի են ունեցել զանգվածային անկարգություններ, որն ուղեկցվել է ՔԿՀ-ի գույքի ոչնչացմամբ, բռնության կիրառմամբ։

 

Նախնական քննությամբ փաստական տվյալներ են ձեռք բերվել առ այն, որ դեպքի օրը ՀՀ ԱԱԾ և ՀՀ ԱՆ քրեակատարողական վարչության աշխատակիցները սահմանված կարգով ՀՀ ԱՆ «Գորիս» քրեակատարողական հիմնարկի 3 խցերում կատարել են խուզարկություններ, որից հետո իրավասու մարմնի կողմից որոշում է կայացվել դատապարտյալներից մեկին՝ դատապարտված և կալանավորված անձանց շրջանում հեղինակություն վայելող Կ.Հովհաննիսյանին, այլ քրեակատարողական հիմնարկ տեղափոխելու մասին: Նշված տեղափոխությանը խոչընդոտելու նպատակով մի շարք կալանավորված և դատապարտված անձինք հրահրել են անկարգություններ՝ հայհոյել, սպառնալիքներ հնչեցրել իրավապահ և արդարադատության համակարգի ծառայողների հասցեին, ոտքերով և տարբեր առարկաներով հարվածել խցերի դռներին և կերակրադռնակներին, այրված իրեր նետել խցերի կերակրադռնակներից և պատուհաններից:

 

Անկարգությունների հետևանքով վնասվել և կոտրվել է ՔԿՀ-ի գույքը, բռնություն գործադրվել հիմնարկի անվտանգության ապահովման բաժնի աշխատակցի նկատմամբ։

 

Ձեռք բերված բավարար ապացույցների հիման վրա՝ 6 անձի առաջադրվել է մեղադրանք ՝ ՀՀ քրեական օրենսգրքի 225-րդ հոդվածի 2-րդ մասի հատկանիշներով՝ անկարգություններին մասնակցելու համար: Նրանց մասով հայտարարվել է նախաքննության ավարտի մասին, և քրեական գործը՝ մեղադրական եզրակացությամբ, ուղարկվել է նախաքննության օրինականության նկատմամբ հսկողություն իրականացնող դատախազին:

 

Ձեռնարկվում են անհրաժեշտ քննչական և դատավարական այլ միջոցառումներ՝ անկարգություններին մասնակից անձանց ամբողջական շրջանակը պարզելու և նրանց գործողություններին համապատասխան քրեաիրավական գնահատական տալու ուղղությամբ։
