Իրավապաշտպանը կարծում է, որ երեքի մահվան համար 31-ը չեն կարող մեղավոր լինել. «Փաստ»

«Փաստ» օրաթերթը գրում է.
Անցած օրերին դատարանի դահլիճից ազատ արձակվեցին «Սասնա ծռեր» զինված խմբի անդամներ Արեգ Կյուրեղյանը, Տիգրան Սարգսյանը, Հովհաննես Վարդանյանը, Արամ Մանուկյանն ու Արամ Հակոբյանը, ապա և՝ Սեֆիլյանի գործով բոլոր մեղադրյալները: Երեկ ևս մի քանի հոգի ազատ արձակվեցին «Սասնա ծռերի» գործով: Խոսքն, անշուշտ, խափանման միջոցը փոխելու մասին է:
Այս իրադարձությունների ֆոնին ոմանց կողմից սկսել էր այդ ազատումներն անարդարացի անվանելու գործընթացը: Մասնավորապես՝ խոսակցություններն այն մասին էին, որ «Սասնա ծռեր»–ին ազատ են արձակում, իսկ ՊՊԾ գնդում զոհված երեք ոստիկանների հարազատների մասին չեն մտածում:
«Փաստ»–ի հետ զրույցում իրավապաշտպան Ժաննա Ալեքսանյանը նշեց, որ այդ հարցադրումները դուրս են իրավական ոլորտից, զգացական են ու շահարկելու նպատակ ունեն:
«Հայտնի է, որ հարուցված է քրեական գործ, երկու հոգու նկատմամբ մեղադրանք է առաջադրվել: Իհարկե, դեռ նրանց մեղքը չի հաստատվել, բայց ամեն դեպքում կա առաջադրված մեղադրանք ոստիկանների սպանության համար:
Քանի որ այդ մասով քննությունը դեռ չի ավարտվել, չեմ կարծում, որ իմաստ կա այդքան աղմուկ անելու այս թեմայով: Քննությունը պետք է հանգամանալից բացահայտումներ անի, որպեսզի պարզվի՝ ինչպես են տեղի ունեցել այդ դեպքերը, ինչ հանգամանքներում»,– նշեց նա: Ոստիկանների հարազատները նաև գնացել էին դատարան, որտեղ ասում էին, թե բոլորը պետք է պատասխանատվության ենթարկվեն: Սակայն, ինչպես իրավապաշտպանն է ասում, օրենքով չի նախատեսվում, որ 31 հոգի պետք է պատասխան տա ոստիկանների սպանության կամ մահվան դեպքերի համար: Նա խորհուրդ տվեց բոլորին և հատկապես այդ ոստիկանների հարազատներին համբերատար լինել ու սպասել քննության արդյունքներին: Քանի որ դեռ հայտնի չէ՝ կհաստատվե՞ն առաջադրված մեղադրանքները, կհաստատվե՞ն ամբողջությամբ, թե՞ ոչ:
«Մենք չենք կարող կանխատեսումներով, կանխագուշակումներով զբաղվել: Այստեղ պետք են փաստացի, կոնկրետ տվյալներ, որոնց մենք պետք է ապավինենք: Պետք է սպասել քննության ավարտին: Չեն կարող «Սասնա ծռեր»–ի ողջ խմբին մեղադրանք առաջադրել ոստիկանների մահվան դեպքերի համար»,–նկատեց նա:
Դիտարկմանը, թե զգացական ֆոնի վրա այդ մարդիկ կարծում են, որ բաց թողնելով՝ մեղավորները պատիժ չեն կրի, Ալեքսանյանն ասաց. «Հասկանալի է՝ նրանք մեծ կորուստ են ունեցել, ընտանիք ունեն, պետությունը պետք է հոգ տանի ու մտածի այդ ընտանիքների մասին: Գուցե նրանք բողոք ունեն, գուցե ինչ–որ բան չի բավարարում, գուցե պետությունը ամեն հնարավորը չի արել նրանց հոգսը թեթևացնելու համար, և նրանք մեղավորներ փնտրում են այստեղ՝ բոլորի մեջ: Պետությունը պետք է հասկացնի, թե օրենքն ինչ է նախատեսում և որ օրենքը կիրառվելու է բոլոր դեպքերում»:
Գուցե իրազեկման պակաս կա՞: Սրան ի պատասխան Ալեքսանյանը նկատեց, որ հնարավոր է իրավական մասով տեղեկացված չեն. «Գուցե անձնական–սոցիալական բողոք ունեն և սխալ տեղ են ուղղորդվում: Պետք է ճիշտ հասցեատիրոջը գտնեն և գնան այդ հետքով իրենց հարցերը կարգավորելու համար»:
