Վարչապետը Ոստիկանապետից պահանջեց չմեծացնել քաղաքացիներին տուգանելու հնարավորությունները

Կառավարությունը հավանություն տվեց «Ոստիկանության մասին» Հայաստանի Հանրապետու­թյան օրենքում փոփոխություն կատարելու մասին» օրենքի նախագծին, սակայն վարչապետի հանձնարարականով շարժական արագաչափերի գործունեությունը չի իրականացվի: Ըստ օրենքի նախագծի՝  ճանապարհային ոստիկանության ծառայողները ճանապարհային երթևեկության անվտանգությունն ապահովելիս չեն ապահովում «Ոստիկանության մասին» օրենքում սահմանված` շարժական տեսաձայնագրող կամ լուսանկարահանող տեխնիկական միջոցներով ոչ գաղտնի վերահսկողության մասին ոստիկանության ծառայողի կողմից բանավոր նախազգուշացնելու պահանջը և «փաստորեն, խախտման փաստի արձանագրումը տեղի է ունենում առանց սուբյեկտի համաձայնության», ինչը չի բխում «Անձնական տվյալների պաշտպանության մասին» օրենքի 16-րդ հոդվածի պահանջներից:

ՀՀ կառավարությունն առաջարկում է ներկայացված նախագծով քննարկվող գործող օրենքի հոդվածը թողնել անփոփոխ՝ հաշվի առնելով ներկայացված օրենքի նախագծի և դրա ընդունման հիմնավորման վերաբերյալ մի շարք հանգամանքներ և, միևնույն ժամանակ, իր պատրաստակամությունն է հայտնում համագործակցել օրենսդրական նախաձեռնության հեղինակների հետ՝ հիմնավորման մեջ նշված խնդրի բավարար կարգավորման ուղղությամբ: 

Վարչապետ Նիկոլ Փաշինյանը հետաքրքրվեց, թե ո՞ր շարժական տեսանկարահանող սարքերի մասին է խոսքը՝ ընդգծելով, որ կան 3 տեսակի՝ պետավտոտեսչության ավտոմեքենաների մեջ տեղադրվող, ոստիկանների համազգեստների վրա օգտագործվող տեսախցիկներ և իրավախախտումներ արձանագրող տեսանկարահանող սարքերով ավտոմեքենաները: Ոստիկանապետ Վ. Օսիպյանը նշեց, որ կարգավորումները վերաբերում են, այսպես կոչված, խախտումներ արձանագրող շրջիկ մեքենաներում տեղադրված տեսախցիկներին, սակայն այդ ավտոմեքենաները կահավորված են լինելու տարբերանշաններով:

Վարչապետը նկատեց, որ այս հարցում հակասություններ են ի հայտ գալիս: «Մի կողմից ասում ենք մարդկանց քիչ տուգանենք, մյուս կողմից ասում ենք՝ բերենք այդ շրջիկ մեքենաներն էլ ավելացնենք, որ շատ տուգանենք: Մենք քաղաքական խնդիր ենք ձևակերպել, որ պետք է դադարեցնենք քաղաքացիներին ամեն տեղ տուգանելու քաղաքականությունը, հիմա դուք քննարկում եք, թե ավելի շատ ինչպես տուգանենք: Ոչ, չեն լինելու այդ շարժական տեսանկարահանող մեքենաները, դադարեցնենք քաղաքացիների հետևից ընկնելու քաղաքականությունը: Գուցե նախազգուշացումների համակարգ ներդնենք, խնդրում եմ, պահանջում եմ, հրահանգում եմ, հրամայում եմ չմեծացնել քաղաքացիներին տուգանելու առիթներն ու հնարավորությունները»,- ասաց վարչապետը:

Պատասխանելով Նիկոլ Փաշինյանի հարցին՝ ոստիկանապետը տեղեկացրեց, որ շարժական արագաչափերն այս պահին չեն գործում: Վալերի Օսիպյանը նշեց, որ կառավարության ղեկավարի հանձնարարականի համաձայն շուտով կներկայացվեն տուգանքների չափերը նվազեցնելու առաջարկություններ: «Չեմ ուզում ժամանակից առաջ ընկնել, բայց տուգանքներն էապես նվազելու են»,- ասել է Օսիպյանը:

Հաշվի առնելով օրենսդրական սահմանափակումները՝ նախագծերի ընդունման ժամկետների հետ կապված, ներկայացված նախագծին տրվել է հավանություն, սակայն վարչապետը հանձնարարեց շարժական արագաչափերի գործունեություն չիրականացնել և խնդրին հետագայում անդրադառնալ ու տալ փաթեթային լուծում:
