ՀՀ գյուղնախարարության պաշտոնատար անձանց կողմից չարաշահումների հետևանքով պետբյուջեից ավելի քան 1.4 մլրդ դրամ է փոշիացվել

ՀՀ գլխավոր դատախազության պետական շահերի պաշտպանության վարչությունում ուսումնասիրվել է հողօգտագործողներին գյուղատնտեսական աշխատանքների համար մատչելի գներով պարարտանյութերի ձեռքբերման նպատակով պետական աջակցության ծրագրով բյուջետային սուբսիդավորման գործընթացում պետական շահերի պաշտպանության վիճակը: Այս մասին «Արմենպրես»-ին տեղեկացրին ՀՀ դատախազության հանրային կապերի բաժնից:

 

Ուսումնասիրությամբ պարզվել է, որ 2015թ. նշված ծրագրի շրջանակներում ՀՀ գյուղատնտեսության նախարարությունը պայմանագրով մատակարար ՍՊ ընկերությանը պետական բյուջեից տրամադրել է տարեկան ընդամենը 0.001 տոկոսադրույքով առանց գրավի 3.991.584.000 ՀՀ դրամի բյուջետային վարկ՝ ազոտական պարարտանյութ ձեռք բերելու համար: 

 

Բացի այդ, ծրագրի շրջանակներում 2015թ. ՀՀ գյուղատնտեսության նախարարությունը, առանց շուկայական նվազագույն շահավետ գնի հաշվարկման, նույն մատակարար ՍՊԸ-ին հատկացրել է 2.138.823.000 ՀՀ դրամ սուբսիդիա՝ 33263 տոննա ազոտական պարարտանյութ ձեռքբերելու և հողօգտագործողներին 50 կիլոգրամանոց 1 պարկը 9.215 ՀՀ դրամի փոխարեն 6.000 ՀՀ դրամով մատակարարելու համար: 

 

Մինչդեռ ՀՀ տնտեսական մրցակցության պաշտպանության պետական հանձնաժողովից ստացված տեղեկատվության համաձայն՝ նույն 2015 թվականին այլ տնտեսվարող սուբյեկտների կողմից նույն որակի ազոտական պարարտանյութը ներկրվել է նշված մատակարար ՍՊ ընկերությունից էապես ցածր գներով։ 

 

Պարզվել է նաև, որ 2012-2016թթ. ծրագրերն իրականացնելիս ՀՀ գյուղատնտեսության նախարարության պատասխանատու պաշտոնատար անձինք չեն կատարել ՀՀ կառավարության 2003թ. դեկտեմբերի 24-ի թիվ 1937-Ն որոշմամբ հաստատված պետական բյուջեից իրավաբանական անձանց սուբսիդիաների հատկացման կարգի պահանջները, այսինքն չեն կատարել սուբսիդիայի հիմքում դրված նվազագույն շահավետ գնի նորմատիվների հաշվարկման և ՀՀ ֆինանսների նախարարության հետ համաձայնեցման իրենց ծառայողական պարտականությունները: Արդյունքում միայն 2015թ. ազոտական պարարտանյութի մասով պետական բյուջեից անհիմն 1.427.000.000 ՀՀ դրամ ավել փոխհատուցում է տրվել մատակարար ՍՊԸ-ին՝ պետության համար առաջացնելով ծանր հետևանքներ: 

 

Ընդ որում՝ այդ ՍՊԸ-ի պետական բյուջեի նկատմամբ չկատարած վարկային պարտավորությունը մինչ օրս կազմում է 396.682.378 ՀՀ դրամ: 

 

Նկատի ունենալով, որ արձանագրված խախտումներն առերևույթ պարունակում են հանցագործության հատկանիշներ՝ ՀՀ գլխավոր դատախազության պետական շահերի պաշտպանության վարչությունում ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 2-րդ մասով նախատեսված հանցագործությունների հատկանիշներով հարուցվել է քրեական գործ, որի նախաքննության կատարումը հանձնարարվել է ՀՀ հատուկ քննչական ծառայությանը: 

 

Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
