Դատախազության առաջարկած նախագիծը շրջադարձային կլինի կալանավորման պրակտիկայի խնդիրը լուծելու համար. Արթուր Դավթյան

ՀՀ գլխավոր դատախազը Հայաստանում կալանավորման պրակտիկայի խնդիրը լուծելու անհրաժեշտություն է տեսնում: Ինչպես տեղեկացնում է «Արմենպրես»-ը, անդրադառնալով  կալանքից ազատելու հետ կապված դատախազների դիրքորոշման փոփոխությանը, ՀՀ գլխավոր դատախազ Արթուր Դավթյանը նշեց, որ դատախազությունը երկար տարիներ խոսել է այդ խնդրի մասին և հիմնավորել օրենսդրական բացերով:

 

«Բոլորս էլ սպասողական  այդ խնդիրը կապում էինք նոր քրեական դատավարության  օրենսգրքի ընդունման հետ: Բնականաբար, հանրային պահանջի պայմաններում, երբ շատ ավելի ակնառու դարձավ, որ այդ ոլորտում մենք ունենք իսկապես փոփոխությունների անհրաժեշտություն, մենք լուրջ բարեփոխման գործընթաց իրականացրեցինք:

 

 Նույն կալանքի  պրակտիկայում դեռևս անցած տարի օգոստոսին աշխատանքային խմբի կողմից ուսումնասիրվել է հատկապես եվրոպական փորձը և դրա հիման վրա մենք  ներդրեցինք այնպիսի մոտեցումներ, որոնց արդյունքներով՝ մոտ 20 տոկոսով կալանքի միջնորդությունները պակաս էին»,- ասաց Դավթյանը:

 

ՀՀ գլխավոր դատախազը, սակայն, նշեց, որ այդ փոփոխությունները լիարժեք չէին, ուստի դատախազությունը առաջարկեց նախագիծ, որով շրջադարձային փոփոխություններ կլինեն:

 

«Մենք հրապարակել ենք մեր առաջարկած քրեական դատավարության օրենսգրքի նախագիծը և այդ նոր մոտեցումները, կարծում եմ, որ կունենան շրջադարձային փոփոխություն, որը, բնականաբար , հետագայում կդառնա օրենք: Մենք կիրառության ընթացքում կտեսնենք  դրա արդյունավետության չափաքանակը»,- եզրափակեց Դավթյանը:
