Նորավան համայնքի դպրոցի տնօրենի կողմից յուրացում եւ պաշտոնեական կեղծիք կատարելու քրեական գործն ուղարկվել է դատարան

 Ավարտվել է Սյունիքի մարզի Նորավան համայնքի դպրոցի տնօրենի կողմից յուրացում և պաշտոնեական կեղծիք կատարելու դեպքի առթիվ հարուցված քրեական գործ նախաքննությունը:

 

Ինչպես «Արմենպրես»-ին տեղեկացրին ՀՀ դատախազության հանրային կապերի բաժնից, 2018թ. Հունվարին, քաղաքացու կողմից Սիսիանի բաժնում հաղորդում է ստացվել այն մասին, որ Նորավան համայնքի միջնակարգ դպրոցի տնօրենն իր և իր ամուսնու աշխատավարձերի պլաստիկ քարտերից յուրաքանչյուր ամիս կանխիկացրել է իրենց աշխատավարձերը, որոնց մեծ մասը վերցրել է իրեն:

 

Նախապատրաստված նյութերի հիման վրա ՀՀ քրեական օրենսգրքի 179-րդ հոդվածի 2-րդ մասի 1-ին և 3-րդ կետերով հարոուցվել է քրեական գործ:

 

 Իրականացված նախաքննությամբ հիմնավորվել է, որ Սյունիքի մարզի Նորավանի միջնակարգ դպրոցի տնօրեն Ա.Ա.-ն պաշտոնեական դիրքն օգտագործելով, 2016 թ-ի հունվար ամսից մինչև 2017 թ դեկտեմբեր ամիսը ներառյալ,  մի քաղաքացու միաժամանակ ձևակերպելով բակապահի, վառարան վառողի և պահակի հաստիքներին իր մոտ է պահել նրաշխատավարձի բանկային քարտը,  անձամբ բանկոմատից կանխիկացնելու եղանակով այդ անձին առձեռն յուրաքանչյուր ամիս տալով 20.000 ՀՀ դրամ կանխիկ գումար, մնացած՝ խոշոր չափերով ընդհանուր 1.849.664 ՀՀ դրամ գումարը յուրացրել է:

 

 Պարզվել է նաև, որ տնօրենն այդ անձի հետ 2013թ. կնքել է աշխատանքային պայմանագիր, սակայն խոշոր չափերով՝ վերոնշյալ գումարը յուրացնելու հանգամանքը թաքցնելու նպատակով դրանում ակնհայտ կեղծ տեղեկություններ է մտցրել այն մասին, թե իբր, նշված պայմանագիրը կնքվել է 2013թ. դեկտեմբերին, մինչդեռ պարզվել է, որ տվյալ պայմանագիրը կնքվել է 2018թ. հունվարին:

 

 2018թ. հունիսի 19-ին դպրոցի տնօրեն Ա.Ա.-ին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 179-րդ հոդվածի 2-րդ մասի 1-ին և 3-րդ կետերով և 314-րդ հոդվածի 1-ին մասով: Նրա նկատմամբ որպես խափանման միջոց ընտրվել է ստորագրություն չհեռանալու մասին:

 

 Առաջադրված մեղադրանքում նա իրեն լիովին մեղավոր է ճանաչել, զղջացել կատարած արարքների համար, ամբողջությամբ վերականգնել է իր կողմից պետությանը պատճառված վնասը և խնդրել է մեղմ վերաբերվել: Տնօրենը հայտնել է նաև, որ առանց պետության աջակցության Նորավանի միջնակարգ դպրոցը հիմնովին վերանորոգել է, կատարել է բազմաթիվ շինարարական աշխատանքներ:

 

 Քրեական գործ նախաքննության օրինականության նկատմամբ հսկողություն իրականացնող դատախազը հուլիսի 3-ին հաստատել է մեղադրական եզրակացությունը և քրեական գործի հետ միասին ուղարկել ՀՀ Սյունիքի մարզի ընդհանուր իրավասության առաջին ատյանի դատարան: 

 

Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
