Ռուս զինծառայողի սպանության գործով քրգործը վերադարձվել է ՀՀ քննչական կոմիտեին

ՀՀ գլխավոր դատախազությունը Ռուսաստանի Դաշնության պայմանագրային զինծառայող Իվան Նովիկովի սպանության գործով լրացուցիչ քննություն կատարելու նպատակով քրեական գործը վերադարձրել է ՀՀ քննչական կոմիտե:

«2015 թվականի հունիսի 15-ին ՀՀ քննչական կոմիտեի Շիրակի մարզային քննչական վարչություն է ստացվել Ռուսաստանի Դաշնության քննչական կոմիտեի զինվորական քննչական վարչության 519-րդ զինվորական քննչական բաժնի գրությունը, ինչի համաձայն նշված բաժնի վարույթում ՌԴ քրեական օրենսգրքի 105-րդ հոդվա ծի 1-ին մասի հատկանիշներով քննվում է քրեական գործ, որի նախաքննության ընթացքում հաստատվել է Ռուսաստանի Դաշնության 102-րդ ռազմական բազայի շարքային զինծառայող Ի.Ս.Նովիկովի սպանությանը վերջինիս համածառայակից ընկերոջ՝ պայմանագրային զինծառայող Ի.Վ. Բոսխոմջիևի առնչությունը, ով ձերբակա լվել է և դեպքի կապակցությամբ տվել է ինքնախոստովանական ցուցմունքներ:

Ռուսաստանի Դաշնության քննչական կոմիտեի զինվորական քննչական վարչության 519-րդ զինվորական քննչական բաժինը ղեկավարվելով Ռուսաստանի Դաշնության և Հայաստանի Հանրապետության միջև կնքված «Հայաստանի Հանրապետության տարածքում ռուսական ռազմական բազայի տեղակայման հետ կապված գործերով իրավասության և փոխադ արձ իրավական օգնության հարցերով» համաձայնագրի 3-րդ և 5-րդ հոդվածների պահանջներով' վերոհիշյալ գրությամբ խնդրել է տրամադրել ՀՀ քննչական կոմիտեի Շիրակի մարզային քննչական վարչության վարույթում նույն դեպքի առթիվ հարուցված և քննվող քրեական գործը դեպքի վայրի զննությամբ առգրավվ ած առարկաների և Ի.Ս.Նովիկովի դիակի հետ միասին՝ իրենց վարույթում քննվող քրեական գործին միացնելու նպատակով:

2015 թվականի հունիսի 16-ին ՀՀ քննչական կոմիտեի Շիրակի մարզային քննչական վարչությունից Շիրակի մարզի դատախազություն է ստացվել նշված քրեական գործը և դեպքի վայրի զննությամբ առգրավված առարկաները՝ ՀՀ գլխավոր դատախազության միջոցով դրանք Ռուսաստանի Դաշնության քննչական կոմիտեի զինվորակա ն քննչական վարչության 519-րդ զինվորական քննչական բաժին ուղարկելու միջնորդությամբ:

Շիրակի մարզի դատախազությունում նշված քրեական գործի ուսումնասիրությամբ պարզվել է, որ այն Ռուսաստանի Դաշնության քննչական կոմիտեի զինվորական քննչական վարչության 519-րդ զինվորական քննչական բաժին ուղարկելու վերաբերյալ Շիրակի մարզային նախաքննական մարմնի դիրքորոշումը չի համապատասխանում գործով ձեռք բերված փաստական տվյալներին, իսկ գործով դեռևս առկա է որոշակի առաջնային դատավարական գործողություններ կատարելու անհրաժեշտություն, ուստի համապատասխան ցուցումներով քրեական գործը վերադարձվել է ՀՀ քննչական կոմիտեի Շիրակի մարզային քննչական վարչություն:

Միաժամանակ պարզաբանվել է, որ Ռուսաստանի Դաշնության և Հայաստանի Հանրապետության միջև կնքված «Հայաստանի Հանրապետության տարածքում ռուսական ռազմական բազայի տեղակայման հետ կապված գործերով իրավասության և փոխադարձ իրավական օգնության հարցերով» համաձայնագրի 1-ին և 3-րդ կետերի իմաստով իրավասու մարմին է հանդիսանում նաև ՀՀ քննչական կոմիտեն»,-«Արմենպրես»-ի հարցմանը ի պատասխան` նշված է ՀՀ գլխավոր դատախազության գրավոր պատասխանում:
