Մեղադրանք է առաջադրվել Հայկ Սարգսյանին՝ սպանության փորձ կատարելու, ապօրինի կերպով հրազեն և ռազմամթերք ձեռք բերելու և պահելու համար

 ՀՀ քննչական կոմիտեի ԵՔՔՎ Կենտրոն և Նորք Մարաշ վարչական շրջանների քննչական բաժնում քննվող քրեական գործով մեղադրանք է առաջադրվել Հայկ Սարգսյանին՝ սպանության փորձ կատարելու, ապօրինի կերպով հրազեն և ռազմամթերք ձեռք բերելու և պահելու համար։

Ինչպես «Արմենպրես»-ին հաղորդում են ՀՀ քննչական կոմիտեից, քրեական գործով կատարված մեծածավալ քննչական գործողությունների արդյունքում պարզվել են Երևան քաղաքի բնակիչ, 1984 թվականին ծնված Դավիթ Սիմոնյանի՝ 2007 թվականի ապրիլի 1-ին հրազենային վնասվածք ստանալու իրական հանգամանքները, առերևույթ հանցագործություն կատարած անձի ինքնությունը։

Ավելի վաղ տեղեկացրել ենք, որ Դավիթ Սիմոնյանը՝ հրազենային վնասվածքով, թիվ 3 կլինիկական հիվանդանոց է տեղափոխվել 2007 թվականի ապրիլի 1-ին՝ Երևան քաղաքի Թումանյան-Նալբանդյան փողոցների խաչմերուկից: Նույն օրը ոստիկանության Կենտրոնական բաժին էր ներկայացել քաղաքացի Ա.Ղևոնդյանը, ներկայացրել ատրճանակ և հայտնել, թե այն գտել է իրենց շենքին կից մանկապարտեզից դեպի նկուղ տանող աստիճանների մոտ, որի հետ անզգույշ վարվելու հետևանքով կրակել է՝ մարմնական վնասվածք պատճառելով ընկերոջը՝ Դ.Սիմոնյանին:

Ոստիկանության Կենտրոնականի քննչական բաժնում 2007 թվականի մայիսի 28-ին որոշում էր կայացվել փաստի առթիվ հարուցված քրեական գործի վարույթը կարճելու և Ա.Ղևոնդյանի նկատմամբ քրեական հետապնդում չիրականացնելու մասին՝ ՀՀ քրեական դատավարության օրենսգրքի 35-րդ հոդվածի 1-ին մասի 4-րդ և 5-րդ կետերով նախատեսված կողմերի հաշտության և բողոքի բացակայության հիմքով:

Նոր երևան եկած հանգամանքներով պայմանավորված՝ 2018 թվականի հուլիսի 3-ին ՀՀ գլխավոր դատախազի կողմից վերացվել է նշված որոշումը, և քրեական գործը ուղարկվել ՀՀ քննչական կոմիտեի Երևան քաղաքի քննչական վարչության Կենտրոն և Նորք-Մարաշ վարչական շրջանների քննչական բաժին` նախաքննություն կատարելու նպատակով։ Նույն օրը քննիչն այն վարույթ է ընդունել և ձեռնարկել անհրաժեշտ քննչական և դատավարական այլ գործողություններ՝ դեպքի հանգամանքները պարզելու ուղղությամբ։

Կատարված նախաքննությամբ փաստական տվյալներ են ձեռք բերվել առ այն, որ Դ.Սիմոնյանն իրականում հրազենային վնասվածքն ստացել է Հայկ Ալեքսանդրի Սարգսյանի բնակության վայրի՝ Երևան քաղաքի Թումանյան փողոցի թիվ 11 շենքի բնակարանի նկուղային հարկում գտնվող սենյակում՝ 2007 թվականի ապրիլի 1-ին՝ ժամը 16:00-ի սահմաններում՝ վերջինիս կողմից արձակված կրակոցի հետևանքով։ Պարզվել է վիճաբանության շարժառիթը, միջադեպին ականատես անձի ինքնությունը։

Ձեռք բերված ապացույցների հիման վրա՝ Հայկ Ալեքսանդրի Սարգսյանին մեղադրանք է առաջադրվել՝ սպանության փորձի և ապօրինի կերպով հրազեն ձեռք բերելու և պահելու համար՝ ՀՀ քրեական օրենսգրքի 34-104-րդ հոդվածի 1-ին և 235-րդ հոդվածի 1-ին մասերով։ Քննիչը միջնորդություն է ներկայացրել դատարան՝ նրա նկատմամբ որպես խափանման միջոց կալանավորումն ընտրելու վերաբերյալ։

Նախաքննությունը շարունակվում է։

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
