Լարված հարաբերություններ հողերի համար. «Փաստ»
SOCIETYԿոտայքի մարզի Բալահովիտ ու Գետարգել և Գեղարքունիքի մարզի Մարտունի ու Վաղաշեն համայնքների բնակիչների միջև վերջին տարիներին լարված հարաբերություններ են եղել:
Բանն այն է, որ Կոտայքի մարզի Բալահովիտ և Գետարգել համայնքների վարչական սահմանների անճշտության հետևանքով Բալահովիտ համայնքի հողերից 1,5398 հա անցել է Գետարգել համայնքին, իսկ Գետարգել համայնքի հողերից 0,8691 հա՝ Բալահովիտ համայնքին, որի պատճառով խնդիրներ են առաջացել իրավունքների պետական գրանցման աշխատանքներում և ավելորդ լարվածություն ստեղծվել երկու համայնքների բնակիչների մոտ: Միաժամանակ Գեղարքունիքի մարզի Մարտունի համայնքի նախկին երկրորդ հատվածի հողերը, որոնք սեփականաշնորհվել են Մարտունի համայնքի բնակիչների կողմից, ընդգրկվել են այդ հողերին սահմանակից Վաղաշեն համայնքի վարչական սահմաններում, ինչը Մարտունի համայնքի և հողի սեփականատերերի մոտ դժգոհություն է առաջացնում:
«Հայաստանի Հանրապետության վարչատարածքային բաժանման մասին» Հայաստանի Հանրապետության օրենքով և կառավարության մի շարք որոշումներով արդեն իսկ ամրագրված են համայնքների վարչական սահմանների նկարագրեր, սակայն մարզերի վարչական սահմանների նկարագրերը այդ օրենքում չեն արտահայտվել Այս խնդիրների կարգավորման ու լուծման նպատակով մշակվել ու Իրավական ակտերի նախագծերի հրապարակման միասնական կայքում շրջանառության է դրվել «Հայաստանի Հանրապետության վարչատարածքային բաժանման մասին» օրենքում փոփոխություններ կատարելու մասին նախագիծը:
Օրենքի նախագծով նախատեսվում է արդեն ամրագրված սահմանների անճշտության վերացում (Բալահովիտ–Գետարգել) և հարևան համայնքների փոխադարձ համաձայնությամբ վարչական սահմանների փոփոխում (ՀՀ Գեղարքունիքի մարզի Մարտունի–Վաղաշեն): Նշված փոփոխությունները քննարկվել և հավանության են արժանացել ՀՀ մարզերի և համայնքների վարչական սահմանների նկարագրման աշխատանքների կարգավորման կառավարական հանձնաժողովի 2016 թվականի հունիսի 3–ի նիստում:
Նախագիծը մշակվել է կառավարությանն առընթեր անշարժ գույքի կադաստրի պետական կոմիտեի կողմից՝ Կոտայքի, Գեղարքունիքի մարզպետների և Բալահովիտ, Գետարգել, Մարտունի, Վաղաշեն համայնքների ղեկավարների առաջարկությամբ:
Օրենքով ամրագրվում են Հայաստանի Հանրապետության մարզերի վարչական սահմանների նկարագրերը, ճշգրտվում է Բալահովիտ–Գետարգել սահմանագիծը և դրա նկարագիրը, փոփոխվում է Մարտունի–Վաղաշեն սահմանի նկարագիրը: Օրենքի նախագծի ընդունմամբ ակնկալվում է մարզերի վարչական սահմանների ամրագրումը օրենքով, համայնքների վարչական սահմանների ճշգրտում, հարևան մարզերի և համայնքների միջև ծագած տարաձայնությունների վերացում, իրավունքների պետական գրանցման խոչընդոտների վերացում:
