SOCIETYՀՀ քննչական կոմիտեի հատկապես կարևոր գործերի քննության գլխավոր վարչությունում քննվող քրեական գործով բացահայտվել է փաստաբանի կողմից խարդախությամբ, կաշառք տալու պատրվակով, խոշոր չափերի գումարի առերևույթ հափշտակության դեպք: Մեղադրանք է առաջադրվել 2 անձի:
Այս մասին հայտնում են ՀՀ քննչական կոմիտեի լրատվական ծառայությունից։
Քննությամբ ձեռք բերված տվյալների համաձայն՝ Մ. Հակոբյանը, 2002 թվականից զբաղվելով փաստաբանական գործունեությամբ, 2018թ. մարտին իր հաճախորդին առերևույթ դրդել է առանձնապես խոշոր չափերով կաշառք տալ պաշտոնատար անձ հանդիսացող, ՀՀ առողջապահության նախարարությանը կից միջգերատեսչական ստացիոնար դատահոգեբուժական փորձաքննությունների հանձնաժողովի անդամներին, որից հետո խարդախությամբ նրանից հափշտակել է խոշոր չափերով՝ 1.200.975 ՀՀ դրամին համարժեք 2.500 ԱՄՆ դոլար գումար:
Մասնավորապես՝ փաստաբանը 2017թ. դեկտեմբերի 14-ին կնքված ծառայությունների մատուցման պայմանագրով ստանձնել է ՀՀ քրեական օրենսգրքի 104-րդ հոդվածի 1-ին մասով նախատեսված հանցագործություն կատարելու մեջ մեղադրվող անձի պաշտպանությունը:
Քրեական գործով նշանակված փորձաքննության արդյունքում ցանկալի եզրակացություն ստանալու համար, ըստ քննության տվյալների, փաստաբանը մեղադրյալի հորեղբորից գումար է պահանջել՝ ՀՀ առողջապահության նախարարությանը կից միջգերատեսչական ստացիոնար դատահոգեբուժական փորձաքննությունների հանձնաժողովի անդամներին որպես կաշառք տալու համար:
2018թ. մարտի 17-ին փաստաբանն իր գրասենյակում մեղադրյալի հորեղբորից ստացել է պայմանավորված գումարի մի մասը՝ 1.200.975 ՀՀ դրամին համարժեք 2.500 ԱՄՆ դոլարը՝ մնացած մասը փորձաքննության ավարտից հետո տալու պայմանով և առերևույթ հափշտակել այն։
Ձեռք բերված բավարար ապացույցների համակցությամբ՝ փաստաբանին մեղադրանք է առաջադրվել՝ ՀՀ քրեական օրենսգրքի 178-րդ հոդվածի 2-րդ մասի 2-րդ կետով և 34-38-312-րդ հոդվածի 3-րդ մասի 1-ին կետով, մեղադրյալի հորեղբորը՝ ՀՀ քրեական օրենսգրքի 34-312-րդ հոդվածի 3-րդ մասի 1-ին կետով:
Նախաքննությունն ավարտվել է, և քրեական գործը՝ մեղադրական եզրակացությամբ, ուղարկվել նախաքննության օրինականության նկատմամբ հսկողություն իրականացնող դատախազին:
