Ինչպե՞ս է ավագանու կազմից ընտրվելու Երևանի քաղաքապետ. «Փաստ»
POLITICS«Փաստ» օրաթերթը գրում է.
Այսօր Երևանի ավագանու ընտրության քարոզարշավի վերջին օրն է: Ինչ արդյունքներ կգրանցվեն, պարզ կլինի կիրակի երեկոյան: Քարոզարշավի ողջ ընթացքում մենք հարթակ տրամադրեցինք գրեթե բոլոր մասնակից ուժերին: Բացառություն եղան երկուսը. մի ուժը հարգելի պատճառներով դուրս եկավ ընտրապայքարից, իսկ մյուսն ընտրել էր բացառապես հարթակային ու «լայվային» քարոզարշավի ճանապարհը:
Իսկ ինչ է սպասվում ընտրություններից հետո, ինչպե՞ս է ավագանին ընտրելու քաղաքապետ: Ըստ «Երևան քաղաքում տեղական ինքնակառավարման մասին» ՀՀ օրենքի, քաղաքապետի ընտրություններն անցկացվում են նորընտիր ավագանու առաջին նիստի ընթացքում: Առաջին նիստն անընդհատ է, բացառությամբ ընդմիջման ու հանգստի համար նախատեսված ժամանակի, մինչև քաղաքապետի ընտրությունը:
Եթե ավագանու ընտրությունների արդյունքով ընտրություններին մասնակցող կուսակցություններից մեկը ստանում է ավագանու անդամների տեղերի 50 տոկոսից ավելին ապա այդ կուսակցության թեկնածուների ցուցակի առաջին հորիզոնականում գտնվող անձը օրենքի ուժով համարվում է ընտրված քաղաքապետ: Եթե այդ կուսակցության ընտրական ցուցակի առաջին հորիզոնականում գտնվող անձը չի համապատասխանում քաղաքապետին առաջադրվող պահանջներին, հրաժարվում է կամ ավագանու ընտրությունների արդյունքով որևէ կուսակցություն չի ստանում ավագանու անդամների տեղերի 50 տոկոսից ավելին, ապա քաղաքապետն ընտրվում է գաղտնի քվեարկության միջոցով:
Ավագանու խմբակցությունները կարող են իրենց կուսակցության թեկնածուների ցուցակի առաջին հորիզոնականում տեղ զբաղեցրած անձին առաջադրել որպես քաղաքապետի թեկնածու, իսկ եթե վերջինս հրաժարվում է կամ չի համապատասխանում քաղաքապետին առաջադրվող պահանջներին, ապա խմբակցությունը կարող է առաջադրել տվյալ կուսակցության թեկնածուների ցուցակի համապատասխանաբար հաջորդ այն անձին, որը համաձայն է առաջադրվել որպես թեկնածու և համապատասխանում է քաղաքապետին առաջադրվող պահանջներին:
Եթե առաջադրվել է մեկից ավելի թեկնածու, ապա քաղաքապետ է ընտրվում այն թեկնածուն, որը ստանում է ավագանու անդամների ընդհանուր թվի ձայների մեծամասնությունը: Եթե առաջադրված թեկնածուներից որևէ մեկը չի ստանում ավագանու անդամների ընդհանուր թվի ձայների մեծամասնությունը, ապա առավելագույն ձայներ ստացած երկու թեկնածուների միջև անցկացվում է քվեարկության երկրորդ փուլ: Եթե հավասար ձայների պատճառով հնարավոր չէ պարզել առավելագույն ձայներ ստացած երկու թեկնածուներին, ապա երկրորդ փուլին մասնակցում են նաև հավասար ձայներ ստացած մյուս թեկնածուները:Երկրորդ փուլում քաղաքապետ է ընտրվում առավելագույն ձայներ ստացած թեկնածուն: Ձայների հավասարության դեպքում անցկացվում է լրացուցիչ քվեարկություն` քվեաթերթիկում ընդգրկելով միայն հավասար ձայներ ստացած անձանց: Լրացուցիչ քվեարկության արդյունքով ձայների հավասարության դեպքում առավելությունը տրվում է տարիքով ավագին:
Քվեարկության երկրորդ փուլն ու լրացուցիչ քվեարկությունն անցկացվում են անմիջապես հիմնական քվեարկության արդյունքները հրապարակելուց հետո:
Եթե առաջադրվել է մեկ թեկնածու, ապա վերջինս ընտրվում է քաղաքապետ, եթե նրա օգտին կողմ քվեարկած ձայները ավելի են դեմ քվեարկած ձայների թվից և ավելի են ավագանու անդամների ընդհանուր թվի 40 տոկոսից:
