Սամվել Ալեքսանյանի կողմից ցուցարարին հարվածելու տեսագրության հիման վրա քրեական գործ չի հարուցվել, հանցակազմ չկա
POLITICSԱյս տարվա ապրիլ ամսին՝ բողոքի ակցիաների օրերին, ՀՀ ԱԺ պատգամավոր Սամվել Ալեքսանյանի մասնակցությամբ միջադեպի հիման վրա քրեական գործ չի հարուցվել:
Tert.am-ը ՀՀ գլխավոր դատախազություն հարցում էր, թե արդյոք իրավական ընթացք տրվել է ապրիլ ամիսն բողոքի ակցիաների օրերին տարածված այն տեսագրությանը, ըստ որի՝ ԱԺ պատգամավորը հարվածում է ցուցարարի կամ արդյոք տարածված տեսանյութը պարունակել է հանցագործության հատկանիշներ:
Նշված հարցի վերաբերյալ ՀՀ գլխավոր դատախազությունից պատասխանել են, որ Youtube կայքում տեղադրված տեսանյութը ՀՀ քրեական դատավարության օրենսգրքի 180-181-րդ հոդվածներով սահմանված կարգով նյութեր նախապատրաստելու և քրեական գործ հարուցելու համար հիմքերի բավարար լինելը պարզելու նպատակով 2018 թվականի ապրիլի 25-ին ուղարկվել է ՀՀ ոստիկանության Երևան քաղաքի վարչության Մալաթիայի բաժին:
«Հաղորդման հիման վրա նախապատրաստվել են նյութեր, որի ընթացքում կատարվել են դատավարական անհրաժեշտ գործողություններ, այդ թվում բացատրություններ են վերցվել ենթադրյալ դեպքին ականատես անձանցից, որոնց արդյունքում Սամվել Ալեքսանյանի գործողություններում ՀՀ քրեական օրենսգրքով նախատեսված հանցագործությունների հատկանիշներ չեն բացահայտվել: 2018 թվականի մայիսի 2-ին հետաքննության մարմինը որոշում է կայացրել հանցակազմի բացակայության հիմքով քրեական գործ հարուցելը մերժելու մասին»:
