ՄԻՊ-ը պատժախուց տեղափոխված կալանավորներին և դատապարտյալներին հեռախոսային հաղորդակցությունից զրկելու հարցով դիմել է ՍԴ
SOCIETYՀայաստանի Հանրապետության մարդու իրավունքների պաշտպանը դիմել է Սահմանադրական դատարան՝ վիճարկելով օրենսդրության այն կարգավորումների սահմանադրականությունը, որոնք նախատեսում են պատժախուց տեղափոխված կալանավորներին և դատապարտյալներին նամակագրությունից, հեռախոսային խոսակցություններից և հաղորդակցության այլ ձևերից, այսինքն՝ արտաքին աշխարհի հետ կապից մեխանիկական զրկում:
Ինչպես տեղեկացրին ՀՀ մարդու իրավունքների պաշտպանի աշխատակազմի հանրային կապերի բաժնից, Պաշտպանին հասցեագրված բողոքների քննարկումը և կանխարգելման ազգային մեխանիզմի մշտադիտարկումը ցույց է տալիս, որ պատժախուց տեղափոխված կալանավորված անձանց և դատապարտյալների արտաքին աշխարհի հետ կապին առնչվող օրենսդրական կարգավորումները չեն համապատասխանում Սահմանադրությանը և միջազգային չափանիշներին:
Սահմանադրական դատարանին ուղղված դիմումի վիճարկման առարկա են դարձել «Ձերբակալված և կալանավորված անձանց պահելու մասին» ՀՀ օրենքի և ՀՀ քրեակատարողական օրենսգրքի, ինչպես նաև Կալանավորվածներին պահելու վայրերի և ուղղիչ հիմնարկների ներքին կանոնակարգը հաստատելու վերաբերյալ Կառավարության որոշման համապատասխան դրույթները:
Գործող օրենսդրությամբ կալանավորված անձի կամ դատապարտյալի նկատմամբ պատժախուց տեղափոխելը՝ որպես տույժի միջոց կիրառելու դեպքում նա մեխանիկորեն՝ անկախ որևէ հանգամանքից, բացառություն չնախատեսող արգելքի ուժով զրկվում է արտաքին աշխարհի հետ կապից: Այսպիսի կարգավորումների պայմաններում, ստացվում է, որ տույժի այդ միջոցն ունի լրացուցիչ զրկանքներ պատճառելու բնույթ, որոնք որևէ կապ չունեն տույժի նպատակների կամ պատճառների հետ: Ինքնին տույժի միջոցը կիրառվում է քրեակատարողական հիմնարկի պետի որոշմամբ, իսկ հաղորդակցությունից զրկելու հարցը հիմնավորման չի արժանանում: Ստեղծված պայմաններում չի ցուցաբերվում նաև անհատական մոտեցում ու չի գնահատվում ազատազրկվածի վարքագծի ռիսկայնությունը:
Նշվածն առաջացնում է անձի մասնավոր և ընտանեկան կյանքի անձեռնմխելիության, ինչպես նաև հաղորդակցության ազատության սահմանադրական իրավունքների իրացման խնդիր, քանի որ զրկումը նախատեսվում է պատժախուց տեղափոխելու յուրաքանչյուր դեպքում: Սահմանադրական դատարան ներկայացված դիմումում հիմնավորվում է նաև, որ վիճարկվող կարգավորումները հակասում են նաև Սահմանադրության համաչափության, ինչպես նաև հիմնական իրավունքների և ազատությունների վերաբերյալ Սահմանադրությամբ ամրագրված դրույթները մեկնաբանելիս ՀՀ վավերացրած՝ մարդու իրավունքների վերաբերյալ միջազգային պայմանագրերի հիման վրա գործող մարմինների պրակտիկան հաշվի առնելու սահմանադրական սկզբունքներին:
