SOCIETYՀոկտեմբերի 2-ին Երևան քաղաքի դատախազություն է ստացվել ՀՀ մշակույթի նախարարի գրությունը Երևանի Արամի փողոցի հուշարձան-շենքին կից տարածքում առանց լիազորված մարմնի համաձայնության իրականացված հողային աշխատանքների հետևանքով հուշարձան-շենքի կայունությունը վնասելու վերաբերյալ:
Երևան քաղաքի դատախազի հանձնարարությամբ գրությունն ուղարկվել է ՀՀ ոստիկանաւթյան Երևան քաղաքի վարչություն՝ առերևույթ հանցագործության դեպքի առթիվ նյութեր նախապատրաստելու և քրեական գործ հարուցելու հարցը լուծելու նպատակով:
Նախապատրաստված նյութերով պարզվել է, որ Երևան քաղաքի Բյուզանդի փողոցի 26/1 հասցեում շինարարական աշխատանքներ կատարելու թույլտվություն ունեցող «Օլդ սիթի» ՓԲԸ-ն, 2017թ. սեպտեմբերի 20-ին «Շինարարական կապալի պայմանագիր» է կնքել «ԱՎԱԳՅԱՆԲՐԻՋ» ՍՊԸ-ի հետ: Դրա հիման վրա վերջինս 2017թ. սեպտեմբերից մինչև 2018թ. մարտ ամիսը Երևան քաղաքի Բյուզանդի փողոցի 26/1 հասցեում իրականացրել է հողի քանդման, բարձման և տեղափոխման աշխատանքներ՝ թույլ տալով «Պատմության և մշակույթի անշարժ հուշարձանների ու պատմական միջավայրի պահպանության և օգտագործման մասին» ՀՀ օրենքով սահմանված՝ հուշարձանի պահպանական գոտիների, օգտագործման ռեժիմի պահպանման, ինչպես նաև հուշարձաններ ներառող տարածքներում շինարարական և այլ աշխատանքներ իրականացնելիս հուշարձանների պահպանության ու անվթարության ապահովման պահանջների խախտումներ:
Կատարված շինարարական աշխատանքների հետևանքով վտանգվել է Երևան քաղաքի Արամի 23 հասցեում գտնվող՝ «Հայ փոքրիկ երգիչներ» միջազգային ասոցիացիա բարեգործական հասարակական կազմակերպությանը պատկանող և տեղական նշանակության հուշարձան համարվող շենքի կայունությունը, և այն վնասվել է:
Նկատի ունենալով, որ նախապատրաստված նյութերն առերևույթ պարունակում են պատմամշակութային հուշարձան վնասելու հանցագործության հատկանիշների մասին վկայող տվյալներ՝ ՀՀ ոստիկանաւթյան Երևան քաղաքի վարչությունում հարուցվել է քրեական գործ՝ ՀՀ քրեական օրենսգրքի 264-րդ հոդվածի 1-ին մասով:
Մինչդատական վարույթի նկատմամբ հսկողություն իրականացնող դատախազի կողմից քրեական գործը նախաքննություն կատարելու նպատակով Երևան քաղաքի դատախազի կողմից հոկտեմբերի 19-ին ուղարկվել է ՀՀ քննչական կոմիտեի Երևան քաղաքի քննչական վարչություն:
