ՀՀ նախագահը չի ստորագրել «Ազգային ժողովի կանոնակարգ» օրենքում փոփոխություններ կատարելու նախագիծը և դիմել է ՍԴ

ՀՀ նախագահ Արմեն Սարգսյանը չի ստորագրել «ԱԺ կանոնակարգ» օրենքում լրացումներ և փոփոխություններ կատարելու մասին օրինագիծը և որոշել է դիմել Սահմանադրական դատարան՝ օրինագծի՝ Սահմանադրության պահանջներին համապատասխանության հարցը որոշելու համար:

Նախագահի աշխատակազմի՝ սույն փաստին վերաբերող հայտարարությունն ամբողջությամբ ներկայացնում ենք ստորև։ 

«Հանրապետության նախագահի պաշտոնն ստանձնելու առաջին իսկ օրվանից նախագահ Արմեն Սարգսյանն իր պարտականությունների կատարման ընթացքում ներմուծել է նոր մշակույթ՝ յուրաքանչյուր գործողություն պետք է միտված լինի հստակ նպատակի իրականացմանը և հիմնված լինի իրավունքի գերակայության սկզբունքի վրա:

Այս մոտեցումն ընկած էր նաև Սահմանադրական դատարանի դատավորի թեկնածու առաջադրելու առաջին փորձի հիմքում, երբ հաշվի առնելով տարբեր քննարկումների ընթացքում հնչեցված դիտարկումները և առաջարկները՝ նախագահ Սարգսյանը նախաձեռնեց թեկնածու առաջադրելու նպատակով խորհրդատվական գործընթաց:

 
 



Նույն մոտեցումն է գործում նաև յուրաքանչյուր օրենք ստորագրելիս: Լինի դա նոր ընդունված օրենք, թե գործող օրենքում փոփոխություն, այն ստորագրելու համար նախագահը և իր աշխատակազմը համակարգային վերլուծում են՝ թե արդյոք առկա են առերևույթ սահմանադրաիրավական խնդիրներ, որքանով է նոր օրենքը կամ օրենսդրական փոփոխությունը նպաստում կոնկրետ խնդրի լուծմանը, գնահատվել են արդյոք ազդեցության հավանական զարգացումները: Բոլոր օրենքները պետք է համապատասխանեն Սահմանդրությանը և ծառայեն իրենց նպատակներին՝ միտված լինելով կոնկրետ խնդիրների կանոնակարգմանը:

Ազգային ժողովի՝ 2018 թվականի հոկտեմբերի 2-ի արտահերթ նիստում ընդունված «Ազգային ժողովի կանոնակարգ» Հայաստանի Հանրապետության սահմանադրական օրենքում լրացումներ և փոփոխություններ կատարելու մասին» ՀՀ սահմանադրական օրենքը տարաբնույթ մեկնաբանությունների և քննարկումների տեղիք տվեց:

Օրենքի վերաբերյալ փաստացի արձանագրվեց հանրության մի ստվար զանգվածի անհամաձայնությունը: Հավատարիմ իր մոտեցմանը՝ նախագահ Սարգսյանը հանձնարարեց իր աշխատակազմին ավելի խորն ուսումնասիրել տվյալ հարցի վերաբերյալ միջազգային փորձը, ինչպես նաև ներկայացված Օրենքի փոփոխությունները՝ իրենց հիմնավորմամբ:

Օրենքի փոփոխությունների, ինչպես նաև «Ազգային ժողովի կանոնակարգ» օրենքի գործող խմբագրության վերաբերյալ իրականացված ուսումնասիրությունները վկայում են որոշակի առերևույթ սահմանադրա­իրավական խնդիրների մասին:

Հաշվի առնելով վերոգրյալը և նպատակ ունենալով ապահովել Սահմանադրության գերակայությունը՝ նախագահ Սարգսյանը որոշել է դիմել Սահմանադրական դատարան՝ ներկայացված օրենքը Սահմանադրության պահանջներին համապատասխանության հարցը որոշելու համար»:

Հիշեցնենք, որ ԱԺ կանոնակարրգ օրենքի փոփոխությամբ առաջարկվում էր, որ Քննիչ հանձնաժողովը ժամանակավոր որոշ խոչընդոտների դեպքում նիստն ընդհատի, և ընդհատված նիստը շարունակվի, երբ վերանան այն հանգամանքները, որոնք հիմք են հանդիսացել նիստն ընդհատելու համար:

Օրինագծի ձևակերպումներից լայն շրջանակներում մտավախություն էր առաջացել, որ ԱԺ կանոնակարգ օրենքը փոխում են, որ վարչապետի հրաժարականից հետո ԱԺ-ի՝ իրավունքի ուժով ցրվելու հնարավորությունը կանխեն։
