Փախուստի փորձ «Նուբարաշեն» քրեակատարողական հիմնարկից. մեղադրանք է առաջադրվել 8 անձի

Հայաստանի Հանրապետության քննչական կոմիտեի ՀԿԳ քննության գլխավոր վարչությունում քննվող քրեական գործով պարզվել են «Նուբարաշեն» քրեակատարողական հիմնարկից կատարված փախուստի փորձի՝ էական նշանակություն ունեցող հանգամանքները, հստակեցվել հանցագործություն կատարած անձանց շրջանակը։

Ինչպես «Արմենպրես»-ին տեղեկացրին ՀՀ քննչական կոմիտեի դեպարտոամենտի տեղեկատվության և հասարակայնության հետ կապերի բաժնից, փախուստի փորձի մասին ահազանգն ստացվել է 2018 թվականի ապրիլի 25-ին, նույն օրը հարուցվել է քրեական գործ, որի շրջանակներում կատարված մեծածավալ քննչական գործողությունների արդյունքում բավարար տվյալներ են ձեռք բերվել փախուստի փորձի եղանակի, դրա կատարմանն 8 անձի մասնակցության վերաբերյալ։

Նախնական քննության տվյալներով՝ ՀՀ ԱՆ «Նուբարաշեն» քրեակատարողական հիմնարկի 6-րդ մասնաշենքի թիվ 008 խցում պահվող թվով 11 կալանավորված անձինք և դատապարտյալներ 2018թ. ապրիլի 25-ին՝ ժամը 15:00-ի սահմաններում, քրեակատարողական հիմնարկի անվտանգության ապահովման բաժնի կրտսեր մասնագետի կողմից, օրենքով սահմանված կարգով, ուղեկցվել են 6-րդ մասնաշենքում տեղակայված զբոսախուց:

Զբոսախցի մուտքի դուռը փակելու պահին, կալանավորված անձանցից մեկը բռնություն է գործադրել ուղեկցող անձի նկատմամբ և նրան մտցրել զբոսախուց, զրկել դիմադրություն ցույց տալու հնարավորությունից, որի ժամանակ մեկ ուրիշ կալանավոր տեսուչի մոտից խլել է մասնաշենքի խցերի դռների կախովի փականների բանալիները, ինչպես նաև` մասնաշենքերի մուտքերի և խցերի դռների փականների բանտային բանալին:

Չենթարկվելով քրեակատարողական հիմնարկում վարքի պահպանման վերաբերյալ գործող կանոններին, բռնության գործադրումն ու փախուստի փորձը դադարեցնելուն ուղղված տեսուչի կոչերին՝ կալանավորներից ոմանք բացել են 6-րդ մասնաշենքի 6 տարբեր խցերի դռները և իրենց հետ փախուստի դիմելու կոչով դիմել կալանավորված օտարերկրյա քաղաքացիներին:

Քրեական գործով ձեռք բերված ապացույցների համաձայն՝ փախուստի փորձին միացել է ընդհանուր առմամբ 8 կալանավորված և դատապարտված անձ, ովքեր պահվել են թիվ 008 և 009 խցերում, բոլորն էլ՝ օտարերկրացի (ԻԻՀ քաղաքացի)։ Վերջիններս, անցնելով նկուղային հարկի միջանցքներով, հասել են 1-ին մասնաշենքի մուտքի դռանը, բռնություն գործադրել ծառայություն իրականացնող քրեակատարողական հիմնարկի անվտանգության ապահովման բաժնի աշխատակցի նկատմամբ, սակայն չեն կարողացել բացել մասնաշենքի մուտքի դուռը և դիմել փախուստի, քանի որ տեսուչի ահազանգով անմիջապես թիվ 1 մասնաշենք են ժամանել քրեակատարողական հիմնարկի անվտանգության ապահովման բաժնի ծառայողները ու կանխել փախուստի փորձը:

ՀՀ ՔԿ ՀԿԳ քննության գլխավոր վարչության վարույթում քննվող քրեական գործով ձեռք բերված ապացույցների համակցությամբ՝ 8 անձի մեղադրանք է առաջադրվել՝ ՀՀ քրեական օրենսգրքի 34-355 հոդվածի 2-րդ մասի 1-ին կետով:

Նախաքննությունը շարունակվում է։ Կատարվում են անհրաժեշտ քննչական և դատավարական գործողություններ՝ բազմակողմանի, օբյեկտիվ և լրիվ քննությունն ապահովելու, կատարված փախուստի փորձին այլ անձանց հնարավոր առնչությունը պարզելու ուղղությամբ։

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
