«Առավոտ». Երբ իրավունք չունենք մեղադրել մարդկանց «ստրկամտության» մեջ

Ներկայացնում ենք թերթի խմբագրականից մի հատված.
«Այս դեպքը տեղի է անեցել 1998 թվականի նախագահական ընտրությունների ժամանակ, բայց կարող էր կատարվել 5, 10, 15 կամ 20 տարի առաջ։ Կարող է տեղի ունենալ նաև այս տարվա դեկտեմբերի 6-ին։ Գյուղերից մեկում համայնքի ղեկավարն իր մոտ էր կանչել գյուղացիներից մեկին, որի որդին ձերբակալված էր։ Գյուղապետը նրան ասել էր. «Քո որդին կարող է ստանալ 2 տարի պայմանական, իսկ կարող է ազատագրկվել 10 տարով։ Դա կախված է քեզնից, եթե գյուղը «ճիշտ» քվեարկի, որդիդ կգա տուն։ Հակառակ դեպքում դու նրան 10 տարի չես տեսնի»։
Դուք լինեիք այդ գյուղացու տեղը, ինչպե՞ս կվարվեիք։ Գուցե բողոքեիք ընդդիմադիրներին, իրավապաշտպաններին կամ լրագրողներին ՝ իմանալով, որ դրանից ոչ մի օգուտ չի լինի, և գյուղապետը, առավել ևս ՝ իրավապահները «սուխոյ ատկազ կկանգնեն»։ Բայց շատ ավելի հավանական է, որ դուք սուսուփուս ամբողջ գյուղով մեկ կընկնեիք դռնեդուռ, կաղաչեիք ձեր համագյուղացիներին, որ նրանք քվեարկեն ՝ «ինչպես որ պետքն է», քանի որ դրանից է կախված ձեր որդու ճակատագիրը։ Ինչպես կվարվեի՞ք, եթե այդ համագյուղացիներից մեկը լինեիք։ Դարձյալ շատ մեծ հավանականություն կա, որ ձեր քվեով կփորձեիք փրկել ձեր հարևանի զավակին։
Ուշադրության դարձրեք, այս դեպքում չկա ոչ ծեծ, ոչ ջարդ, ոչ քվեատուփերի լցոնում, ոչ էլ նույնիսկ ընտրակաշառք։ Առկա են, իհարկե, հանցագործության նշաններ, որը, սակայն, բավականին դժվար է ապացուցել։ Առկա է նաև ապացույց, որ մեր իրավական և դատական համակարգը ենթարկվում է իշխանության քաղաքական շահերին։ Մենք իրավունք ունե՞նք նման դեպքերում մարդկանցից հերոսական ջանքեր պահանջելու՝ պետական մեքենայի պարտադրանքին դիմանալու։ Կարծում եմ՝ այս պահին իրավունք չունենք։ Ոչ էլ ՝ մեղադրել այդ մարդկանց «ստրկամտության» մեջ»,–գրում է թերթի խմբագիրը։
