Քրեակատարողական հիմնարկից փախուստի փորձ կատարելու համար մեղադրանք է առաջադրվել երկու կալանավորի

ՀՀ ՔԿ ԵՔՔՎ Էրեբունի և Նուբարաշեն վարչական շրջանների քննչական բաժնում քննվող քրեական գործով մեղադրանք է առաջադրվել քրեակատարողական հիմնարկի երկու կալանավորի՝ ՔԿՀ աշխատակիցների կյանքի կամ առողջության համար վտանգավոր բռնություն գործադրելով կամ դա գործադրելու սպառնալիքով, որպես զենք օգտագործվող առարկայի գործադրմամբ ազատազրկման վայրից փախուստի փորձ կատարելու համար:

Ավելի վաղ հայտնել էինք, որ 2018թ. դեկտեմբերի 6-ին՝ ժամը 7։20-ին, ՀՀ ոստիկանության Էրեբունու բաժին ահազանգ է ստացվել այն մասին, որ նույն օրը՝ ժամը 4։40-ի սահմաններում, կանխվել է ՔԿ հիմնարկի 33 և 25 ամյա կալանավորների փախուստը:

Ահազանգից անմիջապես հետո դեպքի վայր է մեկնել ՀՀ ՔԿ ԵՔՔՎ Էրեբունի և Նուբարաշեն վարչական շրջանների քննչական բաժնի քննչական խումբը։

Դեպքի առթիվ ՀՀ ՔԿ ԵՔՔՎ Էրեբունի և Նուբարաշեն վարչական շրջանների քննչական բաժնում հարուցվել է քրեական գործ՝ ՀՀ քրեական օրենսգրքի 34-355-րդ հոդվածի 2-րդ մասի 1-ին, 2-րդ և 3-րդ կետերով:

Կատարված անհետաձգելի քննչական գործողությունների, այդ թվում՝ դեպքի վայրի զննությամբ, պարզվել է, որ «Նուբարաշեն» ՔԿ հիմնարկի 1985 և 1993 թվականներին ծնված կալանավորները, առերևույթ փախուստ կատարելու վերաբերյալ գալով նախնական համաձայնության, մասնաշենքի 2-րդ հարկում գտնվող խցի արտաքին պատը նախապես քանդելու` բետոնը քերելու և քարն առանձնացնելու միջոցով պատի վրա անցք բացելու եղանակով, հայտնվել են արգելագոտում։ Ապա օգտվելով մառախլապատ եղանակի պատճառով անտեսանելիության պայմաններից, հաղթահարելով փշալարերի առաջին արգելապատնեշը՝ ներթափանցել են հսկիչ հետքային արահետ, հագուստներով մեկուսացնելով բարձր լարման տակ գտնվող փշալարերի երկրորդ արգելապատնեշը՝ այն նույնպես հաղթահարել են, սակայն միացել է ահազանգման համակարգը։

Ահազանգից անմիջապես հետո հիշյալ տեղամասին են մոտեցել ծառայություն իրականացնող ՔԿ հիմնարկի պահպանության ապահովման բաժնի աշխատակիցները:

Իրենց ծառայողական պարտականություններից ելնելով, նախազգուշացնելով օրինական պահանջը չկատարելու դեպքում զենք կիրառելու մասին՝ ՔԿ հիմնարկի աշխատակիցները փորձել են կանխել փախուստը։

Սակայն կալանավորներից մեկը, հարձակվելով աշխատակցի վրա և վերջինիս առողջության համար վտանգավոր բռնություն գործադրելով, կիրառելով ձեռնամարտի հնարքներ, հարմարեցված առարկան որպես զենք գործադրելու սպառնալիքով, պահանջել է չխոչընդոտել իրենց։ Սակայն ՔԿՀ աշխատակիցները հաղթահարել են կալանավորի դիմադրությունը՝ այդ կերպ կանխելով նրանց փախուստը։

Ձեռք բերված բավարար ապացույցների հիման վրա՝ քրեակատարողական հիմնարկի 33 և 25 ամյա կալանավորներին մեղադրանք է  առաջադրվել՝ ՀՀ քրեական օրենսգրքի 34-355-րդ հոդվածի 2-րդ մասի 1-ին, 2-րդ և 3-րդ կետերով:

Նախաքննությունը շարունակվում է, միջոցներ են ձեռնարկվում՝ դեպքի հանգամանքների օբյեկտիվ, լրիվ և բազմակողմանի քննությունն ապահովելու ուղղությամբ:
