Քննչական կոմիտեն քրեական գործ է հարուցել առերևույթ պաշտոնեական լիազորությունները չարաշահելու դեպքի առթիվ
SOCIETYՀՀ Քննչական կոմիտեում ստացվել և վարույթ է ընդունվել պաշտոնեական լիազորությունները չարաշահելու դեպքի առթիվ ՀՀ ԱԱԾ քննչական դեպարտամենտում հարուցված քրեական գործը:
Ինչպես տեղեկացրին ՀՀ քննական կոմիտեի դեպարտամենտի տեղեկատվության և հասարակայնության հետ կապերի բաժնից, նախաքննության ընթացքում պարզվել է, որ Երևանի քաղաքապետարանի աշխատակազմի քաղաքաշինության և հողի վերահսկողության վարչության, ՀՀ քաղաքաշինության նախարարության քաղաքաշինության պետական տեսչության, ՀՀ արտակարգ իրավիճակների նախարարության պետական հրդեհային և տեխնիկական անվտանգության տեսչության, ինչպես նաև «Տեխնիկական անվտանգության ազգային կենտրոն» ՊՈԱԿ-ի պաշտոնատար անձինք, անձնական շահագրգռվածությունից ելնելով, չարաշահելով իրենց պաշտոնեական դիրքը, 2009 թվականի ապրիլից պատշաճ վերահսկողություն չեն սահմանել Երևան քաղաքի Ամիրյան 4/5, 4/14, 4/24 հասցեներում իրականացվող շինությունների շինարարության ընթացքում առկա շեղումներին:
Վերոհիշյալ կառույցները չեն արձանագրել շինարարության ընթացքում առկա շեղումները, իսկ 2012 թվականի փետրվարի 26-ին վավերացրել են շինարարության շահագործման փաստագրման վերաբերյալ փաստաթղթերը՝ հաստատելով, թե, իբր, վերոհիշյալ հասցեներում կառուցվող անավարտ շինությունների շինարարությունը 2012 թվականի փետրվարի 27-ին ավարտվել է, և այն համապատասխանում է նախագծային փաստաթղթերին, Երևանի քաղաքապետարանի կողմից տրված շինարարության թույլտվություններին, և հիշյալ շինությունները պատրաստ են շահագործման համար, ինչն էական վնաս է պատճառել նշված շինություններում անշարժ գույք ստանալու իրավունք ունեցող քաղաքացու, ինչպես նաև՝ այլ անձանց իրավունքներին և օրինական շահերին:
Դեպքի առթիվ հարուցվել է քրեական գործ՝ ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 1-ին մասի հատկանիշներով:
Կատարվում է նախաքննություն, ձեռնարկվում են անհրաժեշտ քննչական և դատավարական այլ գործողություններ՝ դեպքի բազմակողմանի, լրիվ և օբյեկտիվ քննությունն ապահովելու, պաշտոնեական լիազորություններն առերևույթ չարաշահած անձանց շրջանակը պարզելու, նրանցից յուրաքանչյուրի գործողություններն անհատականացնելու և համապատասխան քրեաիրավական գնահատական տալու ուղղությամբ:
Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀքրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
