Վերաքննիչը վերացրել է Հարությունյանն ընդդեմ ՀՔԾ պետի գործով որոշումը
SOCIETYՎերաքննիչ քաղաքացիական դատարանը բավարարել է «Մարտի 1»-ի քրեական գործով քննչական խմբի նախկին ղեկավար Վահագն Հարությունյանի փաստաբանների բողոքը եւ վերացրել առաջին ատյանի որոշումը։ Հիշեցնենք, որ Հարությունյանը ՀՔԾ պետ Սասուն Խաչատրյանից պահանջում է հերքել իր հասցեին հնչեցրած հայտարարությունները՝ համարելով դրանք զրպարտություն։ Օրինակ՝ Սասուն Խաչատրյանը, խոսելով գործի մասին, նշում է, որ սա կարեւոր բացահայտում է, փորձ է արվել կոծկել գործի իրական հանգամանքները, իրեղեն ապացույց հանդիսացող առնվազն 1000 պարկուճներ փոխարինվել են ներքին զորքերի սպառազինության մեջ գտնվող հրազեններից կրակված պարկուճներով: Առաջին ատյանը հայցադիմումը վերադարձրել է՝ նշելով, որ հայցադիմումը և դրան կցված լիազորագիրը չեն պարունակում նշում հայցադիմումը ստորագրած հայցվորի ներկայացուցիչ փաստաբան Հարություն Հարությունյանի անձնագրային տվյալները: Ինչո՞ւ փաստաբանը չլրացրեց հայցը եւ դիմեց միանգամից Վերաքննիչ դատարան, ոչ թե առաջին ատյան։ «Մենք գտանք, որ դատարանը ակնհայտ անհիմն ակտ է կայացրել, միայն անձնական տվյալները չէին խնդիր, մի շարք այլ հիմքեր էր նշել, այդ պատճառով մենք դիմեցինք Վերաքննիչ, ոչ թե առաջին ատյան։ Վերաքննիչ դատարանը մանրամասն վերլուծել է քաղաքացիական դատավարության օրենսգրքի պահանջները եւ ամրագրել, որ վերաքննիչ բողոքի բոլոր հիմքերը հիմնավորված է, հետեւաբար՝ դատարանի որոշումը ենթակա է վերացման։ Որոշումը ուժի մեջ է մտնում կայացման պահից եւ բողոքարկման ենթակա չէ»,-ArmDaily.am-ի հետ զրույցում ասաց փաստաբան Հարություն Հարությունյանը՝ հավելելով, որ վերաքննիչ դատարանը հիմնավոր է համարել իր ներկայացրած պատճառաբանություններն ու հիմնավորումները։ Դրանցից մեկով, օրինակ, նշվում է, որ փաստաբանը անձնագիր ներկայացնելու պարտավորություն չունի եւ այլն։ Այժմ փաստորեն Երեւան քաղաքի ընդհանուր իրավասության դատարանը պետք է քննի Հարությունյանի հայցը ընդդեմ ՀՔԾ պետի։
