Փաստաբանը Վահագն Հարությունյանին կալանավորելու որոշում կայացրած դատավորի դեմ հաղորդում է ներկայացրել
POLITICS«Մարտի մեկի» գործով քննչական խմբի նախկին ղեկավար, այժմ հետախուզման մեջ գտնվող Վահագն Հարությունյանի պաշտպան Միհրան Պողոսյանը հաղորդում է ներկայացրել Դատավարների ընդհանուր ժողովի կարգապահական հարցերի հանձնաժողով՝ դատավոր Արտուշ Գաբրիելյանին կարգապահական պատասխանատվության ենթարկելու պահանջով։ Այս մասին NEWS.am–ին հայտնեց Միհրան Պողոսյանը։
Հիշեցնենք, որ 2018թ. դեկտեմբերի 30-ին Երևանի ընդհանուր իրավասության դատարանի դատավոր Արտուշ Գաբրիելյանն առանց պաշտպանական կողմի մասնակցության՝ Վահագն Հարությունյանի նկատմամբ երկրորդ անգամ կալանքի որոշում է կայացրել։
Նշենք, որ նույն դատավորը քննում է նաև Վահագն Հարությունյանի նկատմամբ հետախուզում հայտարարելու քննիչի որոշման դեմ ներկայացրած բողոքը։
NEWS.am–ի հետ զրույցում Միհրան Պողոսյանը նշեց, որ Արտուշ Գաբրիելյանն իր պաշտպանյալի խափանման միջոցի հարցը քննարկելիս որևէ գործողություն չի կատարել պաշտպանական կողմին ծանուցելու համար։
Ավելի վաղ Վահագն Հարությունյանը NEWS.am–ի հետ զրույցում հայտարարել էր, որ դատարանը գաղտագողի որոշում է կայացրել երկրորդ անգամ իրեն կալանավորելու։ Նրա խոսքով՝ առանց պաշտպանական կողմի մասնակցության խափանաման միջոցի հարց քննարկելը պաշտպանական իրավունքի կոպտագույն խախտում է։
Հիշեցնենք, որ 2018 թ. դեկտեմբերի 30-ին Երեւանի ընդհանուր իրավասության դատարանը Վահագն Հարությունյանի նկատմամբ երկրորդ անգամ կալանքի որոշում կայացրեց։
Մարտի 1-ի գործով ապացույցներ կեղծելը կազմակերպելու համար մեղադրվող Վահագն Հարությունյանին առաջադրված մեղադրանքը լրացվել է 2018թ. դեկտեմբերին։
Նա, որպես մեղադրյալ է ներգրավվել ՀՀ ՔՕ 308–րդ հոդվածի 2–րդ մասով (պաշտոնեական լիազորությունները չարաշահելը, որն անզգուշությամբ առաջացրել է ծանր հետեւանքներ) եւ 309–րդ հոդվածի 2–րդ մասով (պաշտոնեական լիազորություններն անցնելը, որը զուգորդվել է բռնություն, զենք կամ հատուկ միջոցներ գործադրելով):
Նշենք, որ Երեւանի ընդհանուր իրավասության դատարանը Վահագն Հարությունյանին կալանավորելու որոշում էր կայացրել նաեւ 2018թ. նոյեմբերի 2–ին՝ առանձնապես ծանր հանցագործության վերաբերյալ քրեական գործով ապացույցներ կեղծելը կազմակերպելու համար։ Սակայն դեկտեմբերի 12–ին Վերաքննիչ քրեական դատարանը բեկանել էր առաջին ատյանի որոշումն ու վերացրել Վահագն Հարությունյանի նկատմամբ կիրառված խափանման միջոց կալանքի որոշումը։
Վահագն Հարությունյանն այս տարվա հուլիսին ազատվել էր Քննչական կոմիտեի նախագահի տեղակալի, հատկապես կարեւոր գործերի քննության գլխավոր վարչության պետի պաշտոնից:
