ՄԻՊ-ի հայտարարությունը՝ Մհեր Ենոքյանի ներման գործընթացի շուրջ քննարկումների վերաբերյալ

Մարդու իրավունքների պաշտպանի ուսումնասիրությունները ցույց են տալիս, որ սոցիալական ցանցերում վիրավորանքն ու ատելության խոսքը, մասնավոր կյանքին միջամտությունը ստանում է համատարած բնույթ։ Ընդ որում, մտահոգիչ է այն, որ դա արվում է մասնագիտական քննարկումներն ու պաշտոնական իրավական ընթացակարգերը անտեսելու ու հարցադրումներն առավելապես հուզական դիտանկյունից քննարկելու պայմաններում:

Հաշվի առնելով, որ հարցը ստացել է հասարակական լայն արձագանք՝ Մարդու իրավունքների պաշտպանը հարկ է համարում ընդգծել`

1. Անթույլատրելի է, երբ քննարկումը զուգորդվում է հարցի, այդ թվում՝ հանցանքի համար պատիժ կրող անձի, նրա կնոջ, հարցի վերաբերյալ կարծիք հայտնող այլ անձանց նկատմամբ վիրավորանքով և նրանց մասնավոր ու ընտանեկան կյանքին շարունակական միջամտությամբ: Դիտարկումն արձանագրել է նաև տուժողի իրավահաջորդների նկատմամբ վիրավորանքի, նրանց մասնավոր և ընտանեկան կյանքին միջամտության ու կրկնակի զոհացման (վիկտիմիզացիայի) դեպքեր։

Իհարկե, որևէ հարցի հանրային ազատ քննարկումը ժողովրդավարական կարևոր ձեռքբերում է: Դրանով հանդերձ՝ ցանկացած այդպիսի քննարկում պետք է ընթանա այլոց իրավունքների և ազատությունների հարգման ու համերաշխության մթնոլորտում: Մարդու արժանապատվությունն անխախտելի է և կազմում է յուրաքանչյուրի իրավունքների ու ազատությունների անփոխարինելի հիմքը:

2. Պետք է նկատի ունենալ, որ կոնկրետ իրավիճակում ներման խնդրագրի քննարկման հարցով տեղի է ունենում իրավական ընթացակարգ: Սա ենթադրում է այդ ընթացակարգի կանոնների պահպանում, ինչպես նաև այդ գործընթացի վերաբերյալ հանրային իրազեկմանն ուղղված անհրաժեշտ աշխատանքներ: Ակնհայտ է, որ պետությունը բավարար աշխատանք չի տարել ներման ինստիտուտի էության, ներման գործընթացի վերաբերյալ հանրությանն իրազեկելու ուղղությամբ։

3. Մարդու իրավունքների պաշտպանը, հատկապես վերջին տարիների հաղորդումներում ու զեկույցներում, հետևողականորեն արձանագրել է, որ տարիներ շարունակ Հայաստանի քրեակատարողական համակարգն ունեցել է պատժողական բնույթ: Չնայած պետության պոզիտիվ պարտավորությանը՝ գրեթե բացակայել են դատապարտյալի վերասոցիալականացման ուղղությամբ նրա հետ տարվող աշխատանքները, չեն իրականացվել վերականգնողական ծրագրեր։ Հանրության հետ չեն տարվել իրազեկման անհրաժեշտ աշխատանքներ: Այս ամենի արդյունքն էլ քրեակատարողական քաղաքականության և մասնավորապես՝ պատժից ազատելու հետ կապված հանրային բուռն, իսկ կոնկրետ իրավիճակի առնչությամբ՝ ատելության խոսքի հասնող արձագանքն է:

4. Երկրում քրեական քաղաքականության իրականացման և պատժից ազատելու ինստիտուտների կիրառման գործընթացում չպետք է անտեսվի նաև հանցանքից տուժած անձի լսված լինելու և կարծիք արտահայտելու իրավունքը: Պետությանն է վերապահված նրանց աջակցության ու մյուս իրավունքների ապահովման խնդիրը: Ուստի, իրավական բարեփոխումների քաղաքականություն մշակելիս ու իրականացնելիս պետք է նկատի ունենալ նաև այդ հարցերը:

5. Այս հարցում չափազանց կարևոր է նաև լրատվամիջոցների ու լրագրողների դերը: Ուստի, Մարդու իրավունքների պաշտպանը բոլոր լրատվամիջոցներին ու լրագրողներին խնդրում է հեռացնել վիրավորանք կամ ատելության խոսք պարունակող մեկնաբանությունները՝ անկախ նրանից դրանք արվում են առերևույթ կեղծ, թե իրական օգտատերերի կողմից:
