Փողերի լվացում եւ յուրացում. «Հայաստանի երիտասարդական հիմնադրամ»-ի տնօրենին մեղադրանք է առաջադրվել
SOCIETYՀՀ քննչական կոմիտեի Երեւան քաղաքի քննչական վարչությունում քննվող քրեական գործի շրջանակներում «Հայաստանի երիտասարդական հիմնադրամ»-ի գործադիր տնօրենին մեղադրանք է առաջադրվել` առանձնապես խոշոր չափերով փողերի լվացում եւ առանձնապես խոշոր չափերով յուրացում կատարելու համար, հաղորդում են ՀՀ Քննչական կոմիտեից:
Ավելի վաղ հայտնել էինք, որ 2018թ. մայիսի 25-ին ՀՀ քննչական կոմիտեում ստացվել է «Հայաստանի երիտասարդական հիմնադրամ»-ի հոգաբարձուների խորհրդի անդամ, ԱԺ պատգամավոր Կարեն Ավագյանի դիմումն առ այն, որ ապրիլի 6-ին Հայաստանի Երիտասարդական հիմնադրամի գործադիր տնօրենը հիշյալ հիմնադրամի անունից ինքն իր հետ կնքել է 326.000.000 ՀՀ դրամի փոխառության պայմանագիր:
Դիմումի հիման վրա՝ ՀՀ քննչական կոմիտեի Երեւան քաղաքի քննչական վարչությունում նախապատրաստվել էին նյութեր, որոնց արդյունքներով հարուցվել էր քրեական գործ՝ առանձնապես խոշոր չափերով յուրացում կատարելու դեպքի առթիվ՝ ՀՀ քրեական օրենսգրքի 179-րդ հոդվածի 3-րդ մասի 1-ին կետով։
Նախաքննության ընթացքում պարզվել է, որ «Հայաստանի երիտասարդական հիմնադրամ»-ի գործադիր տնօրենը, 2010 թվականից հանդիսանալով հիմնադրամի գործադիր տնօրեն, 2013 թվականի ապրիլի 29-ից մինչեւ 2018 թվականի մայիսի 22-ն ընկած ժամանակահատվածում յուրացման եղանակով հիմնադրամից հափշտակել է իրեն վստահված առանձնապես խոշոր չափերի գումար:
Նպատակ ունենալով թաքցնել եւ խեղաթյուրել առերեւույթ հափշտակված առանձնապես խոշոր չափի գումարի հանցավոր ծագումը, դրա իրական բնույթը՝ օրինականացրել է այն՝ փոխկապակցված տարբեր ընկերությունների եւ ֆիզիկական անձանց հաշվեհամարներին մաս-մաս փոխանցելու, կանխիկացնելու, ինչպես նաեւ՝ տարատեսակ գործարքներ իրականացնելու միջոցով:
Այսպես՝ գործադիր տնօրենը 2013թ. ապրիլի 29-ից մինչեւ 2018թ. մայիսի 22-ն ընկած ժամանակահատվածում հիմնադրամից յուրացման եղանակով հափշտակված, հանցավոր ճանապարհով ստացված 325.600.000 ՀՀ դրամ գումարի հանցավոր ծագումը թաքցնելու նպատակով, առանձանապես խոշոր չափի՝ 226.464.209 ՀՀ դրամ գումարը, մշակված հանցավոր մեխանիզմների եւ սխեմաների կիրառմամբ, հաշվից հաշիվ փոխանցելու, քողարկելու եւ մասնատելու եղանակով օրինականացրել է: Մասնավորապես՝ հիմնադրամի գործադիր տնօրենը նույն ժամանակահատվածում հիշյալ գումարը կանխիկ փոխանցել է իր մոր անվամբ գրանցված բանկային հաշվեհամարներին:
Այնուհետեւ, 15.05.2013 թվականից մինչեւ 29.12.2016 թվականն ընկած ժամանակահատվածում մոր հաշվեհամարից 539.332 ԱՄՆ դոլար գումարը փոխանցվել է Մեծ Բրիտանիայում գործող բանկերից մեկի հաշվեհամարներին, որից հետո 14.05.2013 թվականից մինչեւ 30.12.2016 թվականն ընկած ժամանակահատվածում Մեծ Բրիտանիայում գործող հաշվեհամարներից 490.583 ԱՄՆ դոլար փոխանցել է կնոջ՝ Մ. Ղ.-ի հաշվեհամարին, ապա կնոջ հաշվեհամարից 477.485 ԱՄՆ դոլար գումարը փոխանցվել է իր՝ հայաստանյան հաշվեհամարին եւ կանխիկացման եւ բանկային փոխանցման եղանակով օգտագործել է իր անձնական կարիքների համար:
2019 թվականի հունվարի 24-ին «Հայաստանի Երիտասարդական հիմնադրամ»-ի գործադիր տնօրենին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 179-րդ հոդվածի 3-րդ մասի 1-ին կետով եւ 190-րդ հոդվածի 3-րդ մասի 1-ին կետով:
Քննիչը միջնորդություն է ներկայացրել դատարան՝ նրա նկատմամբ խափանման միջոց կալանավորումն ընտրելու վերաբերյալ:
