Պետք է ազգովի սուբսիդավորե՞նք հանցագործներին. Փոխնախարարի «աբսուրդ» հայտարարությունը
POLITICSՖինանսների նախարարի տեղակալ Արման Պողոսյանը վստահ է՝ ազգովի չպետք է սուբսիդավորենք հանցագործների պաշտպանությունը՝ փաստաբանական ծառայություններին ավելի քիչ հարկ վճարելու հնարավորություն տալով։ Այս մասին նա ասաց այսօր՝ հունվարի 30-ին, Հարկային օրենսգրքի փոփոխություններին նվիրված հանրային քննարկման ժամանակ։
«Ասում եք, որ փաստաբանական ծառայությունները պետք է ավելի քիչ հարկ վճարեն, որովհետեւ մարդու իրավունքների պաշտպանության, փաստաբանական ծառայությունների հասանելիության, սահմանադրականության եւ այլ հարցեր կան, սակայն հարկի ճշգրտման պարագայում դեռ հարց է հարկը բարձրացվում է, թե հարկը վերականգնվում է իր ճիշտ մակարդակին, միգուցե հիմա է ցածր, սակայն կառավարությունը այդ հարցի պատասխանը չունի»,–նշեց նա։
Փոխնախարարը վստահ է՝ փաստաբանական ծառայություններին ԱԱՀ–ից ազատելով այդպիսով հանցագործներին եւս հնարավորություն են տալիս օգտվել թեթեւ հարկային բեռից. «Այսօր եթե մենք փաստաբանական ծառայություններն ազատենք ավելացված արժեքի հարկից կամ նրանց համար սահմանենք ցածր հարկային բեռ, բոլորն են օգտվելու այդ հարկային բեռից, բոլոր շահառուները, այդ թվում՝ հանցագործները։ Հիմա հարց է ծագում՝ մենք ազգովի պե՞տք է սուբսիդավորենք այդ հանցագործներին»։
Փոխնախարարը իր փաստարկները փորձեց հիմնավորել առողջապահական ծառայությունների օրինակի վրա, նշելով, որ պլաստիկ վիրակատության համար սահմանված ցածր հարկային բեռը տեղին չէ, դրա կարիքը այդ ծառայություններից օգտվողները չունեն. «Այսօր առողջապահական ծառայություններն ազատված են ԱԱՀ–ից, բոլոր տեսակի առողջապահական ծառայությունները՝ պլաստիկ վիրահատությունից մինչեւ առաջին անհրաժեշտության առողջապահական ծառայությունները, մենք ազգովի սուբսիդավորում ենք մեկին, որ գնա իր բարեմասնությունները կարգի բերի, նորմա՞լ է, որ չենք կարողանում սրտի ստենտավորումը 100 տոկոսով պետպատվերով ապահովենք, բայց սուբսիդավորում ենք մարդկանց, որի կարիքն ընդհանրապես չունեն»։
ՀՀ փաստաբանների պալատի նախագահ Արա Զոհրաբյանիր հակադարձեվ, որ ցավալի է, երբ պաշտոնատար անձը մեղադրվող անձին հանցագործ է անվանում. «Դա արդեն իսկ լուրջ վերաբերմունք է եւ լուրջ պիտակավորում է»,–նշեց նա։ ։
Ֆինանսների փոխնախարարն էլ նկատեց, որ ինքը միայն երեւույթը նկատի ուներ եւ հայցեց գործընկերոջ ներողամտությունը իր կողմից իրավաբանական սխալ տերմինների կիրառման համար։
Նշենք, որ Ֆինանսների նախարարությունը շրջանառության մեջ է դրել «Հարկային օրենսգրքում փոփոխություններ եւ լրացումներ կատարելու մասին» ՀՀ օրենքի նախագիծը, որով փաստաբանների, խորհրդատուների եւ հաշվապահների համար շրջանառության հարկի համակարգում աշխատելու սահմանափակումներ են նախատեսվել: Նախագծի համաձայն` փաստաբանները ընդհանուր հարկման ռեժիմ են տեղափոխվելու, 5 տոկոս շրջանառության հարկի փոխարեն 20% ԱԱՀ են վճարելու:
