«Արմավիր» ՔԿՀ դատապարտյալ Արմեն Շամիրյանը վաղաժամկետ ազատ արձակվեց. ՀՔԱՎ

Արմավիրի մարզի ընդհանուր իրավասության դատարանը, Վահե Խալաթյանի նախագահությամբ, փետրվարի 4-ին որոշել է վաղաժամկետ ազատ արձակել 2015-ին 5.5 տարվա ազատազրկման դատապարտված Արմեն Շամիրյանին: Ա. Շամիրյանի շահերը դատարանում ներկայացնում էր Հելսինկյան քաղաքացիական ասամբլեայի Վանաձորի գրասենյակի փաստաբան Արայիկ Զալյանը:

ՀՔԱ Վանաձորի գրասենյակից հայտնում են, որ թեեւ ՀՀ ԱՆ քրեակատարողական ծառայության պետ Ա. Մխոյանը բացասական էր բնութագրել Ա. Շամիրյանի վարքագիծը եւ նպատակահարմար չէր գտել նրան վաղաժամկետ ազատ արձակելուն ներկայացնելը, ՀՀ ԱՆ պրոբացիայի ծառայությունը հակառակ կարծիքն էր հայտնել. նրա վարքագիծը գնահատել էր ոչ այնքան բացասական, հաշվի էր առել նաեւ նրա առողջական խնդիրներն ու հանցագործության համար զղջալը եւ եզրակացրել էր, որ նպատակահարմար է պայմանական վաղաժամկետ ազատ արձակելուն ներկայացնելը կամ ավելի մեղմ պատժատեսակով փոխարինելը:

Այս երկու կարծիքների հիման վրա «Արմավիր» ՔԿՀ պետ Խ. Հարությունյանը դատապարտյալի համաձայնությամբ 2019թ. հունվարի 10-ին որոշել էր միջնորդություն ներկայացնել դատարան՝ վաղաժամկետ ազատ արձակելու կամ ավելի մեղմ պատժատեսակով փոխարինելու հարցով:

Դատախազ Ա․ Զաքարյանը դատարանում առարկեց ներկայացված միջնորդության դեմ՝ իր կարծիքը հիմնավորելով նրանով, որ Արմեն Շամիրյանը նախկինում մի քանի անգամ դատապարտված է եղել:

Դատարանում Ա. Շամիրյանի պաշտպան Արայիկ Զալյանը, ի թիվս այլ հանգամանքների, նշեց, որ Քրեակատարողական ծառայության եզրակացության մեջ Ա. Շամիրյանը բոլոր ցուցանիշերով լավ է բնութագրվել և միայն նախկինում դատապարտված լինելու հիմքով բացասական եզրակացություն է տրվել: Այսինքն՝ բովանդակային առումով Քրեակատարողական ծառայության վերջնական եզրակացությունը հակասում է առանձին ցուցանիշերով բնութագրումներին: Բացի դրանից՝ այն, որ Ա. Շամիրյանը նախկինում մի քանի անգամ դատապարտված է եղել, չի կարող ազդեցություն ունենալ ներկայում նրան վաղաժամկետ ազատ արձակելու որոշման կայացման վրա, քանի որ չի կարելի նույն արարքի համար անձին 2-րդ անգամ դատապարտել, իսկ պատժի կրման ընթացքում նա բացասական վարքագիծ չի դրսևորել:Կողմերի կարծիքները լսելուց հետո դատարանը «Արմավիր» ՔԿՀ-ում արտագնա դատական նիստում որոշեց բավարարել միջնորդությունը և Ա. Շամիրյանին վաղաժամկետ ազատ արձակել:
