ՄԻՊ-ի դիմումի հիման վրա հակասահմանադրական է ճանաչվել պատժախցում հեռախոսակապից, նամակագրությունից մեխանիկական զրկումը

Մարդու իրավունքների պաշտպանի դիմումի հիման վրա Սահմանադրական դատարանը հակասահմանադրական է ճանաչել պատժախուց տեղափոխված կալանավորված անձանց եւ դատապարտյալների արտաքին աշխարհի հետ կապից մեխանիկական զրկում նախատեսող օրենսդրական կարգավորումները: Դատարանն Ազգային ժողովի եւ Կառավարության համար վերջնաժամկետ է սահմանել 2019 թվականի հունիսի 5-ը՝ հնարավորություն տալով վիճարկված դրույթները համապատասխանեցնելու որոշման պահանջներին, այլապես դրանք կճանաչվեն ուժը կորցրած:

Դատարանի որոշմամբ արձանագրվել է, որ վիճարկվող կարգավորումները հակասում են Սահմանադրության այն հոդվածներին, որոնք երաշխավորում են մասնավոր եւ ընտանեկան կյանքի անձեռնմխելիության, հաղորդակցության ազատության իրավունքները, ինչպես նաեւ համաչափության սկզբունքը։

Սահմանադրական դատարանին հասցեագրված դիմումում Մարդու իրավունքների պաշտպանը վիճարկման առարկա էր դարձրել «Ձերբակալված եւ կալանավորված անձանց պահելու մասին» ՀՀ օրենքի եւ ՀՀ քրեակատարողական օրենսգրքի, ինչպես նաեւ Կալանավորվածներին պահելու վայրերի եւ ուղղիչ հիմնարկների ներքին կանոնակարգը հաստատելու վերաբերյալ Կառավարության  որոշման դրույթներ: Դրանցով նախատեսվում էր, որ կալանավորված անձի կամ դատապարտյալի նկատմամբ պատժախուց տեղափոխելը՝ որպես տույժի միջոց կիրառելու դեպքում վերջինս մեխանիկորեն՝ անկախ որեւէ հանգամանքից, բացառություն չնախատեսող արգելքի ուժով զրկվում է արտաքին աշխարհի հետ կապից: Մարդու իրավունքների պաշտպանի դիմումում արձանագրվել է՝ այսպիսի կարգավորումների պայմաններում, ստացվում է, որ տույժի այդ միջոցն ունի լրացուցիչ զրկանքներ պատճառելու բնույթ, որոնք որեւէ կապ չունեն տույժի նպատակների կամ պատճառների հետ: Ինքնին տույժի միջոցը կիրառվում է քրեակատարողական հիմնարկի պետի որոշմամբ, իսկ հաղորդակցությունից զրկելու հարցը հիմնավորման չի արժանանում: Այդ պայմաններում չի ցուցաբերվում նաեւ անհատական մոտեցում ու չի գնահատվում ազատությունից զրկվածի վարքագծի ռիսկայնությունը:

Սահմանադրական դատարանը վերահաստատել է Պաշտպանի դիրքորոշումը, որ պատժախուց տեղափոխված անձանց նկատմամբ կիրառվող լրացուցիչ սահմանափակումները պետք է անմիջական կապ ունենան թույլ տրված խախտման հետ, իսկ հիմնական իրավունքների եւ ազատությունների սահմանափակումները պետք է անհրաժեշտ լինեն իրավաչափ նպատակին հասնելու համար։

Դատարանը հաստատել է Պաշտպանի հետեւությունն այն մասին, որ պատժախցում անձի միայնակ մնալը կարող է առաջացնել հոգեճնշող վիճակ, իսկ կրոնականից բացի այլ գրականություն տրամադրելը կարող է բարենպաստ ազդեցություն ունենալ անձի վրա:

Սահմանադրական դատարանը որոշման հիմքում դրել է նաեւ պատժախուց տեղափոխված կալանավորված անձանց եւ դատապարտյալների արտաքին աշխարհի հետ կապի իրավունքի ապահովման վերաբերյալ Մարդու իրավունքների պաշտպանի վկայակոչած ԵԽ, ԵՄ, ՄԱԿ միջազգային չափանիշները, պրակտիկան եւ այլ երկրների փորձը:
