Վարչապետի նոր` «գրպանային արդարադատությունը»
POLITICSՕրերս ԱԺ նիստում կառավարության ծրագրի քննարկման ժամանակ ՀՀ վարչապետ Նիկոլ Փաշինյանը նշեց, թե «կառավարությունը քննարկում է առանց մեղադրական դատավճռի՝ գույքի վրա բռնագանձում տարածելու մեխանիզմը»: Ավելին, նա հավելեց, թե «այս դեպքում չի գործում անմեղության կանխավարկածը, այլ, կոպիտ ասած, մեղավորության կանխավարկածը, եթե մարդը չի կարողանում ապացուցել, որ այդ գույքը օրինական է ձեռք բերել, այն համարվում է ապօրինի»: Իրականում «Փաստի» տեղեկություններով, նման արտառոց որոշման համար հիմք է հանդիսացել այն մտահոգությունը, որ առաջիկայում ՄԻԵԴ–ում կարող են նորանոր գործեր լսվել «ընդդեմ Հայաստանի», դրանց արդյունքում, ամենայն հավանականությամբ, կընդունվեն հայաստանյան դատարանների վճիռները բեկանող որոշումներ, ըստ այդմ՝ հայրենի դատարանի որոշումների համար պատասխան կտա պետությունը: Նախադեպեր արդեն իսկ կան: Եվ ահա, այս ամենը շրջանցելու և ավելորդ քաշքշուկներից խուսափելու համար իշխանությունները գտել են խնդրի իրավական կարգավորում, ըստ որի, պետությունն առանց դատական գործընթացների կարող է պարզաբանումներ պահանջել տվյալ գույքի ձեռքբերման և ծագման վերաբերյալ: Այլ կերպ ասած՝ Փաշինյանն իր համար ստեղծում է «գրպանային արդարադատություն», որը կարող է օգտագործել ցանկացած ժամանակ ցանկացած անձի նկատմամբ: Ի դեպ, այս տեսակետից պատահական չէր նաև վարչապետի հիշատակումը ՄԻԵԴ–ի մասին. «Մարդու իրավունքների եվրոպական դատարանի դիրքորոշումներում սա համարվում է նորմալ պրակտիկա կոռուպցիայի դեմ պայքարում և չի համարվում մարդու իրավունքների խախտում»:
