ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանը 5-րդ բողոքն է ներկայացրել Մարդու իրավունքների եվրոպական դատարան, որը կապված է կալանավորման դեմ բողոքը անհապաղ չքննելու հետ: Ինչպես տեղեկացնում է «Արմենպրես»-ը, մարտի 23-ին լրագրողների հետ զրույցում այս մասին հայտնեց Քոչարյանի պաշտպաններից Հայկ Ալումյանը: 

Ըստ պաշտպանի` Եվրոպական կոնվենցիայի 5-րդ հոդվածի 4-րդ կետում նշված է, որ յուրաքանչյուր ոք, ով զրկված է ազատությունից իրավունք ունի վիճարկել իրեն կալանավորելու որոշումը և վերադաս դատարանը պարտավոր է անհապաղ նրան ազատ արձակել, եթե կալանավորումը եղել է անօրինական: 

Ալումյանի խոսքով` կան նաև մի քանի վճիռներ, որտեղ ՄԻԵԴ-ը արձանագրել է, որ այդ կոնվենցիոն նորմից բխում է, որ վերադաս դատարանը պարտավոր է անհապաղ քննել բողոքը: 

«Մենք բողոք ենք ներկայացրել Վճռաբեկ դատարան դեռևս դեկտեմբերի 25-ին և մինչև հիմա այդ դատարանը ոչ միայն բողոքը չի քննել, այլ նաև վարույթ չի ընդունել, իսկ դատարանը պետք է անհապաղ քննի բողոքը: Մենք երկար սպասեցինք և մի քանի անգամ հրապարակայնացրեցինք այս խնդիրը, հույս ունենալով, որ Վճռաբեկ դատարանը հետևություն կանի, բայց այդ կառույցը ոնց կար, այդպես էլ մնաց: Մենք որոշեցինք, որ Վճռաբեկ դատարանին ինչ-որ մի բան հասկացնելու ամենակարճ ճանապարհը Եվրոպական դատարանն է»,- ընդգծեց Ալումյանը:

Նա նշեց, որ Հայաստանի օրենքները ստորադաս են Եվրոպական կոնվենցիայի համեմատ և, եթե Հայաստանի օրենքը նախատեսում է, որ 3 ամսվա ընթացքում պետք է Վճռաբեկ դատարանը որոշի վարույթ ընդունելու կամ չընդունելու հարցը, ապա Եվրոպայի կոնվենցիան ասում է, որ կալանավորման հետ կապված հարցը պետք է քննվի անհապաղ: Ուրեմն մեր օրենսդրությունն արդեն նշանակություն չունի: Եթե Վճռաբեկ դատարանը սպասում է, որ 3 ամիսը լրանա և վերջին օրը կայացնի որոշում, ամենայն հավանականությամբ, դա կհամարվի Եվրոպական կոնվենցիայի 5 հոդվածի 4-րդ կետի խախտում: Եվրոպական դատարանի այն գործում, որը վկայակոչվել է գանգատում, ընդամենը 20 օրվա մեջ էր նիստը նշանակվել: Եվրոպական դատարանը համարեց, որ անհապաղ քննելու սկզբունքը խախտված է»,- եզրափակեց Ալումյանը: 

ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանը դեկտեմբերի 7-ից գտնվում է կալանքի տակ:Ռոբերտ Քոչարյանին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 300.1-ին հոդվածի 1-ին մասով: Քննչական ծառայության տարածած հաղորդագրությունում նշվում է, որ 2008 թվականի մարտի 1-ից 2-ն ընկած ժամանակահատվածում Երևան քաղաքում տեղի ունեցած իրադարձությունների վերաբերյալ ՀՀ հատուկ քննչական ծառայությունում քննվող քրեական գործով նախաքննության ընթացքում ձեռք բերված ապացույցների բավարար համակցության հիման վրա 2018 թվականի հուլիսի 26-ին Հայաստանի Հանրապետության պաշտոնաթող Նախագահ Ռոբերտ Քոչարյանին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 300.1-ին հոդվածի 1-ին մասով այն բանի համար, որ նա այլ անձանց հետ նախնական համաձայնությամբ տապալել է Հայաստանի Հանրապետության սահմանադրական կարգը:
