«Վճռաբեկ դատարանի որոշումները միշտ պետք է լինեն տարբերվող՝ բացառապես իրավունքի գերակայության տեսանկյունից: Երկրորդ Նախագահի գործով Վճռաբեկ դատարանի՝ նոյեմբերի 15-ի որոշումը ունեցավ ոչ թե իրավունքի զարգացման, այլ իրավունքի և սահմանադրական սկզբունքների արգելափակման հետևանք:

Մեկ հանգամանք եմ ուզում նշել, բացի այն խնդրից, որ Նախագահի անձեռնմխելիության հարցը, ինչպես նշվել էր Սահմանադրական դատարանի կողմից, ոչ մի կերպ վերջնական լուծված չէ և, չնայած դրան, շարունակվում է նույն տրամաբանությամբ ընթանալ դատավարությունը, ինչն արդեն իսկ չի բխում Սահմանադրության գերակայությունից, դրանից բխող բոլոր հետևանքներով: Հանգամանքը վերաբերում է հենց ՀՀ քրեական օրենսգրքի 300.1-րդ հոդվածին:

Քրեական օրենսգրքի 300.1-րդ հոդվածի ընդունման պահին ՀՀ Սահմանադրության (2005թ. խմբ.) 3-ից 5-րդ հոդվածներով և 6-րդ հոդվածի առաջին մասով նախատեսված նորմերը 2015 թվականի դեկտեմբերի 6-ի սահմանադրական փոփոխությունների արդյունքում էական փոփոխման են ենթարկվել: Այսպիսով հարց է առաջանում ՀՀ քրեական օրենսգրքի 300.1-րդ հոդվածը գործնականում իրացնելիս պետք է ղեկավարվել նախկինում ՀՀ Սահմանադրության 3-6-րդ հոդվածներով թե ներկայումս գործող Սահմանադրության նորմերով, քանի որ դրանց օբյեկտները և կարգավորման շրջանակները էապես տարբերվում են: Օրինակ՝ ՀՀ Սահմանադրության (2005թ. խմբ) 6-րդ հոդվածի առաջին պարբերությունը սահմանում էր, որ «Սահմանադրությունն ունի բարձրագույն իրավաբանական ուժ, և նրա նորմերը գործում են անմիջականորեն։»: Իսկ գործող Սահմանադրության 6-րդ հոդվածի առաջին մասը սահմանում է, որ «Պետական և տեղական ինքնակառավարման մարմիններն ու պաշտոնատար անձինք իրավասու են կատարելու միայն այնպիսի գործողություններ, որոնց համար լիազորված են Սահմանադրությամբ կամ օրենքներով:»: Ավելին՝ գործող Սահմանադրությամբ, բացառությամբ մարդու իրավունքների և հիմնարար ազատությունների սահմանադրական նորմերը չեն գործում անմիջականորեն, այսինքն նման սահմանադրական պահանջ այլևս առկա չէ: Մինչդեռ օրենսդիրը ենթադրաբար հենց այդ սահմանադրական պատվիրանի պաշտպանությանն էր ուղղել 2009 թվականին ընդունված նշված կարգավորումը: Օրինակներ, ի դեպ՝ կարելի է ավել նշել:Այսինքն, 2018 թվականին քննության առնելով 2008 թվականի արարքը, որի վերաբերյալ մեղադրանք է ներկայացվում 2009 թվականին ընդունված նորմով, որն էլ իր հերթին ուղղված էր պաշտպանելու 2005 թվականի խմբագրության սահմանադրական նորմեր, որոնք էլ իրենց հերթին էապես փոփոխվել են 2015 թվականի սահմանադրական փոփոխություններով…:

Հնարավոր եզրահանգումը կարող է լինել այն, որ Օրենսդիրը 2009 թվականից սկսել է պաշտպանել 2015 թվականի սահմանադրական փոփոխություններով առաջարկված նորմերը /ինչն աբուրդ է/ կամ, Քրեական օրենսգրքի 300.1-րդ հոդվածը ՀՀ Սահմանադրության և նույնիսկ քրեական օրենսգրքի սկզբունքներին չի համապատասխանում»,-ֆեյսբուքյան իր էջում գրում է սահմանադրական իրավունքի մասնագետ, իրավաբան Արամ Վարդևանյանը:
