Արդեն տեղեկացրել էինք, որ այցելելով Նորագավիթի մաքսակետ, ՀՀ վարչապետ Նիկոլ Փաշինյանը աշխատաասենյակներից մեկում նկատել էր ՀՀ դրոշը և պահանջել, որ այդ սենյակի աշխատակիցները դիմում գրեն և հեռանան աշխատանքից։ Հասարակության կողմից բուռն քննարկումների առարկա դարձած թեմայի մասին ԼՈՒՐԵՐ.com-ը զրուցել է փաստաբան Հովհաննես Չամսարյանի հետ։ Հարցին, թե արդյոք այստեղ կա իրավական նորմերի խախտում, Չամսարյանը պատասխանեց.

 

 «Առաջին հայացքից, ես կարծում եմ` կա օրենքի խախտում։ Կարծում եմ` նախքան աշխատակցին հորդորելը՝ դիմում գրել և հեռանալ, պետք էր պարզել, թե իրականում ինչ է կատարվել։ Եթե մենք, ըստ էության, ապրում ենք իրավական պետությունում կամ փորձում ենք ստեղծել իրավական պետություն, ապա պետք է իրականցվեր համապատասխան ծառայողական քննություն կամ ցանկացած այլ տեսակի քննություն, որպեսզի պարզվեր, թե ի՞նչ է տեղի ունեցել, ի՞նչ սենյակ է, ու՞մ լիազորությունների շրջանակի մեջ է մտնում մաքուր պահել այն, արդյո՞ք այդ աշխատակիցը խախտել է որևէ ներքին կանոնակարգ, որը հիմք է տալիս ազատել նրան, թե ոչ։ Կարծում եմ` ուղղակի մտնել, տեսնել, որ դրոշը վատ վիճակում է, և դրա համար հեռացնել առաջին պատահած աշխատակցին` իրավական չէ։ Չգիտեմ` հետագայում քննություն կլինի, թե ոչ, բայց, ամեն դեպքում, հանրության մոտ տպավորությունն այնպիսին էր, որ աշխատակցին անհիմն հեռացրեցին՝ առանց կարևոր հանգամանքները պարզելու»։

 

 ԼՈՒՐԵՐ․com-ի հարցին՝ վարչապետն ունի՞ նման լիազորություն մաքսային ծառայության աշխատակցին հեռացնելու համար, փաստաբանը պատասխանեց.

 

«Աշխատակցին աշխատանքից հեռացնելու լիազորությունները պետք է որ ՊԵԿ նախագահինը լինի, հետևաբար, վարչապետը չէ, որ կլուծի պայմանագիրը նրա հետ։ Ըստ էության, վարչապետի լիազորությունների մեջ չի մտնում մաքսային ծառայության այդ աշխատակցին հեռացնելը։ Իհարկե, վարչապետը իրավունք ունի ուսումնասիրություններ անել, բայց նման դեպքերի համար նաև պետք է պատասխանատվություն կրեն ավելի բարձր պաշտոններ զբաղեցնող մարդիկ, քան աշխատակիցը։ Եվ ոչ այս եղանակով, այլ՝ հանգամանքները պարզելով և իրավական հիմքերը պահպանելով»։
