ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանի խափանման միջոցի վերաբերյալ Վերաքննիչ քրեական դատարանի ապրիլի 11-ի որոշումը նախօրեին տրամադրվել է պաշտպանական խմբին:

Վերաքննիչ դատարանը չի փոփոխել առաջին ատյանի դատական ակտը, հաստատված է համարել կաշառքի դրվագով հիմնավոր կասկածի, ինչպես նաև խուսափելու հիմքի բացակայությունը:

Այսմասինտեղեկացնում է Ռոբերտ Քոչարյանի պաշտպանական խումբը:

Ինչ վերաբերում է ՀՀ քրեական օրենսգրքի 300.1-րդ հոդվածով Ռոբերտ Քոչարյանին առաջադրված մեղադրանքին, որով առաջին ատյանի դատարանը մարտի 15-ին բավարարել էր Հատուկ քննչական ծառայության միջնորդությունը՝ խափանման միջոց կալանավորումը ևս երկու ամսով երկարացնելու վերաբերյալ, ապա այս մասով պաշտպանական խումբը համամիտ չէ դատարանի որոշման հետ և գտնում է, որ դատարանը չի կայացրել իր լիազորություններից բխող որոշում, ինչպես նաև պատճառաբանված անդրադարձ չի կատարել պաշտպանների ներկայացրած բողոքներին:

Առաջիկա օրերին պաշտպանական խումբը վճռաբեկ բողոք կներկայացնի:

Հիշեցնենք, որ ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանի պաշտպանական խումբը բողոքարկել էր մարտի 15-ի առաջին ատյանի դատարանի որոշումը, որով բավարարվել էր ՀՔԾ-ի միջնորդությունը՝ Ռոբերտ Քոչարյանի նկատմամբ ընտրված խափանման միջոց կալանավորման ժամանակը ևս երկու ամսով երկարացնելու վերաբերյալ:

Միաժամանակ դատարանը մերժել էր պաշտպանական խմբի կողմից գրավը թույլատրելի ճանաչելու վերաբերյալ միջնորդությունը:

Հիշյալ որոշմամբ առաջին ատյանի դատարանն արձանագրել էր նաև, որ Ռոբերտ Քոչարյանին առաջադրված կաշառքի դրվագով հիմնավոր կասկածը բացակայում է:
