Նոր սահմանադրության ամենամեծ ականը երեխաների իրավունքների մասին հոդվածն է

Վաղուց արդեն գաղտնիք չէ, որ բնական ռեսուրսներից զատ, արևելաեվրոպական ու նախկին խորհրդային պետությունները հետաքրքրություն են ներկայացնում Արևմուտքի ու մասնավորապես Եվրոպայի համար, որպես մեկ այլ՝ շատ ավելի կարևու ու արժեևոր ռեսուրսի համար․․․ այդ ռեսուրսը մեր երեխաներն են։
Հայաստանում դրա մասին չի խոոսվել, բայյց տեղյա՞կ եք արդյոք, որ մոտ երկու տարի առաջ ֆրանսիայում անցկացված մասշտաբային հետազոտությունը ցույց էր տվել, որ 5 տարվա ընթացքում այնտե ծնողներից օտարել էին 2 միլիոն երեխաների, բայց կրկնակի քննելուց հետո, պարզվել էր, որ առնվազն 1 միլիոն երեխայի պարագայում այդպիսի որոշումը ոչ մի բանով արդարացված չէր։ 1 միլիոն․․․ պատկերացնո՞ւմ եք, 1 միլիոն կոտրված ընտանիք, 1 միլիոն բալիկներ՝ խեղված ճակատագրերով ու իլիոնավոր դժգոհ քաղաքացիներ, ովքեր ունեն բոլոր պատճառները սեփական պետական համակարգն ատելու համար։
Հարց է առաջանում, թե Եվրոպայի ինչին են պետք այդքան որդեգրման ենթակա երեխաներ։ Սա ևս արդեն վաղուց ուսումնասիրված ու լավ ներկայացված ֆենոմեն է։ Ինչպես գիտեք, բացի սովոորական զույգերից, ովքեր ասենք խնդիր ունեն երեխա ունենալու հետ, կամ էլ ցանակնում են բացի սեփական երեխաներից, նաև որդեգրված երեխաներ ունենալ, Եվրոպայի շատ երկրներում վաղուց օրինականացված են միասեռ ամուսնություններն ու այդպիսի զույգերին շնոորհված է որդեգրման իրավունք և ի տարբերություն հետերոսեքսուալ զույգերի, միասեռականները հասկանալի պատճառներով չեն կարող միմյանցից երեխա ունենալ, ուստի հանդիսանում են որդեգրման դիմած մարդկանց զգալի մասը։
Հիմա մեր հավեր մասին։ Նոր սահամանդրությունում հատուկ կետ կա՝ երեխաների իրավունքների մասին։ Իրականում աբսուրդ է մարդու իրավունքներից զատ՝ առանձին մի հատ էլ երեխաների իրավունքի մասին դրույթ մտցնել, քանզի ստացվում է, որ կամ երեխան մարդ չէ, կամ էլ պետք է մարդ ասվածի տարբեր կատեգորիաների համար դրույթներ մտցնել։ Իրականում, սա արված է, որպեսզի սահմանադրության ընդունումից հետո, արմատապես փոխեն Հայաստանի յուվենալ օրենսդրությունը և ստեղծեն այնպիսի օրենսդրական միջավայր, երբ հնարավորինս հեշտ կլինի զրկել ծնողական իրավունքներից ՀՀ քաղաքացիներին ու հնարավորինս քիչ խոչընդոտներ կլինեն եվրոպացի զույգերի համար որդեգրել այդ հայ երեխաներին, ընդ որում՝ նաև․․․ ավելի շուտ՝ հատկապես միասեռաան եվրոպացի զույգերին։
Սա միակ բանը չէ, որ հատուկ մտցվել է Եվրոպայի պահանջով, բայց անկասկած, սա կարևորագույն կետերից մեկն է Եվրոպացիների համար և այն կարող է արհավիրքի վերածվել մեր համար, եթե նոր Սահմանադրությունն անց կացնեն։
